1. Why don't we just settle this once and for all and have him reactivated
and sent to Iraq for 1-2 years to "finish up" his duty to the reserves.

2. Whatever. Other kids were being drafted and sent to die in Viet Nam.
He got out of that by getting preferential treatment, sent to a TANG unit, and then scooting before fulfilling his committment. So during war time, not showing up for duty even if it is only weekend warrior stuff, does not mean that you are ABSENT WITHOUT LEAVE? So not being activated when anyone else would have been is right?

Whatever.

He was a deserter. AWOL describes a brief absence.

8. He deserted - There is no other argument
He absented his unit for at least 17 months without authorization and during a period of time when his unit was testing members for drug abuse. I know what happened to Naval Reservists who did the same thing during the same period; they were recalled to active duty and sent packing on general assignment. In fact, some members of the reserve intentionally went AWOL so they would have a job. Along with bush, his superiors in the Air Guard are guilty of malfeasance in office for not holding him accountable for his actions; but maybe, just maybe they did not hold him accountable because of who he was.

12. You can not answer your question until you post the Texas law under
which * served from April 1972 through May 1973.

* was not on active duty with the USAF during that period and was not subject to the UCMJ.

I know the Texas law applying to TANG troops was changed in 1987 but I don't know what it was prior to that time. Do you? :shrug:
