What are the rules/laws for consent? |
|
When publishing or selling photographs, what are the laws on consent of subject? Are they different depending on the use of the image? Are they different depending on the picture?
I appreciate any help in this. I am going to try an sell some pictures this year, and want to avoid any trouble. Thanks!

As a general rule for the USA, any photo used for commercial purposes needs sign-off by all those owning in the copyright. This is where the model releases come in; the model release removes the model/subject from the partial ownership so that the photographer is the only copyright owner of the photo. Makes it easier when dealing with publishers, and other buyers/licensees.
"Commercial use" normally does not include posting a picture on a website.
*This would be the non-lawyer version, worth exactly what you paid for it. :-)
