Earlier question by Feinstein about precedent over-turning, and DuLito agreed that good "justification" would be required for such an overturn of a "precedent like RvWade", yet he refused and couldn't provide one such justification. YET he still said that RvW was not a "super" or a "super-duper" precedent, meaning in his view RvW WAS vulnerable to overturn. So we now can conclude, if the scotus review Row vs Wade, abortion will be up to each individual states to legalize or prohibit, if DaLito gets confirmed.

Saw a friend who told me he hated his mother-in-law.
Saw him a years later and he asked him again how he felt about his MIL. The guy said, well then I was married to her daughter for 1 year, now it's been 21 years, so it's not so bad.
That's not what I asked you. How do you feel about your MIL?
Well I really can't say. I don't want to speak to that question (?)

Is this a good stategy for the Dems? That is the question, not whether the right to choose itself is or is not important. My argument is that focusing on abortion opens up the Dems to criticisms that their opposition to Alito is purely partisan. A majority of the population may support the right to choose, but I think that it would be more important that a majority would probably not support a purely partisan attack. Furthermore, focusing on abortion will give the Christian Right a reason to rally behind Bush and the Republicans. In effect, it would remind his base why they liked the guy in the first place, in a time when I think its more important to erode that base's support for the 2006 elections. Maybe I'm going too far beyond the scope of just this nomination, but I don't think its a good idea to put the abortion question in the front and center of the national stage right now.

It is a good strategy to discuss abortion in that it puts Republicans on the committee in a tough spot. On the one hand, they don't want to make it appear that Alito will definitely overrule Roe v. Wade because they would give a lot of amunition to the Democrats. However, they also don't want to make it appear as though there is something wrong with a nominee that would overrule Roe v. Wade. So it puts them between a rock and a hard spot. Do they go along with the Dems, assuring that Alito won't overrule Roe v. Wade and thus implicitly accept the righteousness of that decision, or do they fight back and potentially compromise their nominee?

That case is almost certainly going to come before the Court. He's just not going to answer anything apecific about it.
Schumer killed him with the abortion line of questioning. It's not that important how he would rule. He can't say that, anyway. What Schumer hammered was that he won't tell the committee right now what he believes, when he proudly touted his belief before. He's not being honest to the committee. THAT is the importance of the abortion questions.

We'll have to see what happens. I hope Alito doesn't make it out of committee and I hope he gets a "down" vote. But if not, so be it.
