2. I say wait until the hearings end
and use the transcripts of the hearings (questions asked and answers avoided) to filibuster (read and re-read the questions and non-answers on the floor of the Senate).

3. Here's my suggestion:
Dems should insist that NSA abuses be resolved before the Alito vote. It's clear this is an Imperial Presidency judge and he should not be able to cast the deciding vote on separation of powers.

Absolute rock-bottom minimum.

5. Bush is not now and never has been the President and no one
he appoints should be confirmed for any position. When BushCo is gone the Dems will have to pack the court (like FDR wanted to) in order to dilute the Repuke influence.
