The fact that there are tens of thousands of people who are currently incarcerated for lesser drug offenses is testament to the fact that American justice is two tiered, one set of rules for the rich and powerful, and another, much more draconian set of rules for the rest of us.

They have drawn flack over the years for defending unpopular groups...such as Neo-Nazis....and their rights to assemble and protest.
The ACLU is passionate about defending civil liberties...that's why it's called The American CIVIL LIBERTIES Union. But somehow this excellent, essential organization has been demonized as some sinister "liburrul" cabal. And that's a pity, since even the likes of Rush Limbaugh can gain assistance from the ACLU.

If the police had a tip that a poor black man was engaging in "doctor farming" in order to get large quantities of oxycontin, would they and the prosecutors have gone through a long process of plea bargaining so that the poor black man would be able to just turn himself in months later?
Fuck no, the police would be breaking down the guy's door hours after receiving the tip, throwing him and any other people in his house to the floor and handcuffing everyone. If he resisted in any way, he'd get the shit beat out of him, because he's drug dealing scum. And they'd keep him in jail on much more than $3000 bail while awaiting the trial, with little prospect of plea bargaining down the charges. We have to have Zero Tolerance when it comes to drug users, after all....

Probation with mandatory rehab. Prop 36/local Drug Court in our County routinely diverts non-violent drug possession/use cases to a rehab program - I know it rankles to see Rushboy appear to walk, but I think this is a good approach for most drug offenses.
Is it evenly applied or administered? That's probably open to a second look, but it is the law here in CA.
