The area was posted as being off limits from noon to 5 pm, apparently to prevent students from gathering at 4:20 pm on 4/20. From what I've read, students gathered across the street and shortly after 4 pm the crowd decided to climb the fence and enter the field. The photos apparently are captures from a video tape shot over an 18 minute time frame. The police and the citizens decided a long time ago it was not worth the officers' time to investigate and arrest students for possession of small amounts of marijuana on a large college campus. If you are caught by the AA police, the weed is confiscated and you pay a $45 fine. No criminal record, just an undescribed civil offense (although if it occurred in AA, most people in Michigan know exactly what the offense was) goes on your record and is expunged in a similar time frame to traffic tickets. There used to be a similar law in East Lansing, but that was overturned by the voters a while ago. I don't know the details, but at the very least, the fine was raised. MSU students don't riot because they smoke weed, they riot because they drink way too much alcohol.

If you get busted in Ann Arbor by the MSP or the county sheriff, well, then you get charged under the state law, which makes possession of under an ounce a misdemeanor. Yeah, you'll probably only get probation and mandatory testing for a first or second offense, but you'll also get a criminal record.

The local media, including the University's own paper, have been covering this and the stories I've seen discuss the trespassing angle. I doubt that many students will be unaware of that fact. Plus, anyone with half a brain knows that picture of someone smoking isn't evidence of what they were smoking. As for the trespassing charge, the issue is going to be whether there is sufficient evidence that the photos (which apparently are captures from a videotape) were taken before 5 pm, since the field was off limits only between noon and 5 and the students apparently didn't begin entering the field until around 4 pm.
