Rush can't vote!
At least I don't think...

Florida is one seven states in which felons cannot vote, even after they are released from prison. They have to go through legal processes--basically sue the state--to have their voting rights restored.

Remember Jeb's crew purging felons from the roll in 2000?

Isn't it going to be funny, when election season 2006 heats up, to hear Rush's tirades--when he can't even vote!

3. Limbaugh never pleaded guilty to anything.
His deal is a walk.

9. To get a deal, he would have had to plead "No Contest"
Meaning that he admits there is enough evidence to convict him if the matter was brought to a trial. Otherwise, why not let a jury decide?

If the matter he was ultimately charged with after the deal was a felony, he is a no-voter. But I think it was a misdomeaner, which means he still has full voting rights.

4. I Think He Effectively Has A Deferred Sentence
As long as he keeps his "nose" clean and passes his drug screens, etc.

His record will be expunged in 18 months. It is essentially sealed.

He is not a felon unless it is unsealed.

My gripe is that this doctor supervising his "aftercare" decides what he can and can't take pharmacologically. So the doctor could be saying that he can take Oxycontin and that would be fine?

Nice to be rich, eh?

If he were poor and black he'd be in jail

5. Yeah he can.
For one thing, he wasn't convicted.

Also, I'm guessing he'd be on this short list anyway:

snip>
...The state automatically restores the rights of some felons after reviewing their records, while others need only fill out a short application. But others, including convicted drug traffickers, sex offenders, violent offenders and those guilty of public corruption, must go through an investigation and wait for a hearing in Tallahassee, which can take years.

6. You don't have to sue the State of Florida
Edited on Mon May-01-06 09:42 PM by William769
All you have to do is apply to have your civil rights restored. And in His case, I doubt they will even make him wait for the application process.

7. The news has been
repeating that he is not allowed to own a gun. How does that differ from the right to vote?

18. The media is wrong
He plead not guilty

He is in a diversion program during which he
- Gets random drug test
- Can have a firearm
- Prolly other restrictions

Diversion programs are common in places where they have drug courts and used elsewhere as well.

His side of the story is now getting out, if accurate it would appear that the DA did not have the case he portrayed he had, like in most celeb trials. I actually think he could well have gotten off in a trial, hung the jury if nothing else. (I have minimal trust in the courts).

He didn't see a judge. He went straight to a probation officer.
They couldn't find a Republican judge so they skipped that part.

10. As part of the deal, he pled "no contest" to a misdemeaner charge
If I'm remembering things right, he ended up with a misdemeaner, not a felony. Voting rights are only stripped from felons, not people who commit misdemeaner offenses. I will have to look the matter up, though, to be sure.

15. Except, We Don't Know What (Besides Pee) Is Allowed In The Cup
for all we know he has doctor prescribed Dilaudid, Oxycontin, Desoxyn, hell maybe even precription marijuana.

The "doctor" who is supervising his care has been supervising him for a couple of years apparently.
