1. It means that we'll learn on Fri. what evidence Fitz really has on Libby

Reggie ordered Fitz to submit the document that specifies the scope of the evidence in the indictment which the prosecution will actually go forward with.

The response from Fitz will no doubt be fascinating. Set some time and bandwidth aside for that tomorrow.

We should send out a heads up on this to the others.

Thanks for doing all this work. I have been going to other blogs and sites for all things Plame lately. Nice to have it here.

Wouldn't it be great to have a daily Plame discussion thread??

What do you think about organizing that??

is the case that compels a prosecutor to provide the defense with the information the prosecutor intends to introduce during the trial, as well as any related information that the defense might find of value in challenging the prosecutor's case. It is commonly associated with appeals, when the defense finds that the prosecutor failed to provide information that tends to assist the defense.

A good example was in my friend Rubin's case. In the mid-1970s, a cassette tape was found, where the police investigators pressured a witness to change his statements about what he saw (actually, what he didn't see), with offers to help get nine felony charges for burglary and armed robbery "dropped," if he would say he saw Carter and Artis outside the bar in Paterson where a triple murder took place. During the trial, the prosecution claimed the witness in question had IDed Rubin the night of the murders, and had not been offered any deals to testify.

This hearing is to discuss the on-going issues regarding what will be provided to Team Libby. It should be interesting to see what is put on the public docket as a result. There may be more interesting things that remain secret. Poor Scooter!
