So why can't Alito - apparently it's ok for SCOTUS nominee's can answer it - he must be afraid that his answer wouldn't go over well.

I sometimes wonder just how friggin stupid these run of the mill republicans are. They aren't part of the inner circle that's amassing all the wealth and power, what are they thinking when they put loyalty to the cabal -- from which they will NOT, in the end, profit much -- ahead of the interests of the nation? Honestly sometimes I want to break down and weep at humanity's greed and ignorance, and these Alito hearings are one of those times. All these greedy, small people scratching for what little semblance of power and "I Me Mine" they can nab. And the Ted Kennedys -- the few that are left -- who are motivated by an authentic desire to better humankind, are prevented from doing as much as they could because of the Lindsey Grahams of this country plucking at their coattails, trying to raise themselves by pulling others down.

The confirmation hearings for Judge Samuel Alito will focus greatly on his stated opposition to Roe v. Wade. The obsession with abortion in American politics has had an anaerobic effect on past confirmation hearings, sucking the air out of other issues. For Alito, this may have the welcomed effect of obscuring a more troubling question from his past writings and cases: Alito's extreme views of government authority over citizens' rights.

Despite my agreement with Alito on many issues, I believe that he would be a dangerous addition to the court in already dangerous times for our constitutional system.almost reflexive vote in favor of government, a preference based not on some overriding principle but an overriding party.

In my years as an academic and a litigator, I have rarely seen the equal of Alito's bias in favor of the government. To put it bluntly, when it comes to reviewing government abuse, Samuel Alito is an empty robe.

Alito's writings and opinions show a jurist who is willing to yield tremendous authority to the government and offer little in terms of judicial review — views repeatedly rejected not only by his appellate colleagues but also by the U.S. Supreme Court.

Roe V Wade is the greatest marketing tool that the GOP has ever had. If they overturned it, the religious freaks would get bored. The War on Christmas doesnt pack much punch.

The organization, co-chaired in the beginning by Asa Bushnell and Shelby Cullom Davis, put forth a magazine called the "Prospect," espousing right-wing views against the inclusion of women, minorities, and other groups into Princeton. IN 21ST CENTURY Washington, fame doesn't last for 15 minutes anymore. It lasts for a single news cycle. There is the big press release. The next morning the major newspapers spell your name right. But by noon the Drudge Report runs a shotgun blast of half-truths and innuendoes, and by evening pundits are sifting through your entrails on CNN and Fox. Can citizen participation in government survive the advent of the Internet search engine?

Late last Thursday, Patrick Leahy, the ranking Democrat on the Senate Judiciary Committee, issued a list of witnesses to testify for the Democrats on Samuel A. Alito Jr.'s nomination to the Supreme Court. I was on that list — a mere writer with a bachelor's degree — among all the distinguished household names. But by the end of the day Friday, I wasn't on the list anymore.

I had been scheduled to testify as an expert on an organization called Concerned Alumni of Princeton. In 1985, on an application for a promotion in the Reagan Justice Department, Alito had touted his membership in CAP, which had opposed coeducation at Princeton and asked for strict quotas limiting the numbers of women and minorities at the university. Alito's membership in the group thus could shed light on his respect for civil rights.

In my case, it was an L.A. Times Op-Ed article I wrote. In "Animals Suffer a Perpetual Holocaust" (April 21, 2003), I defended People for the Ethical Treatment of Animals for using a quote of my grandfather's. Unlike me, my grandfather was a famous man, Isaac Bashevis Singer, who had escaped anti-Semitism in Europe in 1935 and won the Nobel Prize for literature in 1978.

Alito needs to shed his CAP

Almost 20 years ago, the Concerned Alumni of Princeton (CAP) collapsed like a modern House of Usher, so rotten from within from its own deceptions and peculiar madness that it could no longer sustain its own weight. For Supreme Court nominee Judge Samuel Alito '72, the reappearance of CAP in the national press last week because he included it on that now infamous 1985 job application must have been as shocking as the reappearance of Roderick Usher's dead twin sister in Poe's famous story.

Or, it should have been. At the very least, Judge Alito will have to explain to the Senate Judiciary Committee why he paid dues to an outfit whose modus operandi was deceit and dirty tricks. He will have to explain how he permitted himself to belong to an organization that was overtly racist and sexist for its entire 14-year existence ­— at times passionately so, too.

Even today, they lie. The Daily Princetonian reported Friday that CAP's longtime board member Andrew Napolitano '72 denies that the group opposed coeducation! This is like denying that the Catholic Church opposed abortion. Opposition to the presence of women at Princeton was CAP's central precept. Fortunately, your reporter quoted co-founder Shelby Cullom Davis '30 writing in Prospect, CAP's member magazine, in 1973, that he could not "envisage" a future student body of 40 percent women and minorities. More important, according to a 1977 New Yorker article, the group used the same language in its fund raising.

From its founding in 1972 till its unlamented demise in 1986, CAP was an organization that at first openly opposed full coeducation and the representative inclusion of minorities at Princeton, and then when those became "settled issues," continued its opposition to the mere presence of women and minorities at Princeton through tactics ranging from code words to open harassment.
