Hercules vs Wal-mart
Interesting twist on Eminent Domain:

"SAN FRANCISCO (AP) - Wal-Mart Stores Inc. is known for its hardball tactics, but the little city of Hercules has come up with some muscle of its own in a bid to keep the big-box retailer out.

The City Council in the affluent Bay Area suburb will hold a hearing Tuesday to consider using the power of eminent domain to seize the 17 acres where Wal-Mart intends to build a shopping complex. It's a novel approach to a fight that has taken place in communities across America."

1. It's about time a town used Eminent Domain
in a way that really helps a community. Way to go, Hercules, CA.

3. i'm of two minds on it myself.
On the one hand - i whole-heartedly agree with you, that this is more positive way of using eminent domain.


On the other - there is sort of a classist element to it, simply because this is an affluent town, and they would much rather have posher boutiques on that land than a Wal-mart.

4. That is true.
They are probably doing this, at least in part, for elitist reasons. But it if prevents one Wall Mart, and if other towns learn from their example then I'm in favor.
