Federal Court rejects Clarence Allen's DP appeal for Jan 17.

"A 75-year-old condemned inmate at San Quentin moved a step closer to execution Thursday when a federal judge dismissed his claim that executing him next week would be unconstitutionally cruel and unusual because of his age and health problems.

"There is no clearly established United States Supreme Court law which renders petitioner's execution, at his advanced age and with his current physical infirmities, a violation of the cruel and unusual punishment clause of the Eighth Amendment," Judge Frank Damrell Jr. wrote.

California's Supreme Court rejected Allen's claim on Tuesday."

Allen was serving a life sentence for murder, was paroled, and then he began killing the people who had testified against him. When he was captured he had a list of victims, both of those he had recently killed and of future intended victims.

Arnie has refused clemency. However, in fairnes it must be noted that Democratic governors have also refused clemency for over 20 years.
