Alito - the impeachment option
Edited on Sun Jan-15-06 09:25 AM by LiberalEsto
We're not completely screwed yet.

There is still one remaining check against having a completely right-wing dominated Supreme Court, and that is impeachment.

From the Annenberg Center web site:

"Once a Justice has been confirmed, he or she can serve on the Supreme Court for life “during good behavior.” Supreme Court Justices can only be removed through resignation or impeachment. The only Supreme Court Justice ever to have been impeached by the House of Representatives was Samuel P. Chase, in 1804. The Senate vote failed, and he remained on the Supreme Court until his death in 1811."

If we can take back Congress and hang on to it, we will still have the option of impeaching any Supreme Court justice who jeopardizes our freedoms.

If Alito gets the appointment, we have to work harder than ever to take back Congress in November.

So don't despair.

In the mid-1950s, the right-wing John Birch Society embarked on a massive campaign to impeach Supreme Court Justice earl warren following his many liberal rulings, including the landmark Brown vs. Board of Education ruling that ordered desegregation of schools. "Impeach Earl Warren" signs were plastered all over the US in the late 1950s.

Here is an excerpt from the UC Berkeley Newsletter:

UC Berkeley launches oral history project on Earl Warren's clerks

By Kathleen Maclay, Media Relations | 08 June 2004

"In addition to the 1954 desegregation ruling, the Warren Court took numerous steps to expand civil rights, such as strengthening the individual's right to privacy, overhauling legislative apportionment, and establishing "Miranda rights" after arrest.

Warren attracted fierce criticism from conservatives during his 16-year tenure as chief justice. The John Birch Society urged his impeachment, and President Richard Nixon railed against what he called the judicial activism of the court headed by the controversial Republican, who had been a California governor and attorney general."
