The Free Republic raised the affirmative defense of fair. The Free Republic lost in the District Court, and has appealed to the U.S. Court of Appeals for the 9th Circuit.

And Fair Use is why we are only allowed to snip no more than four paragraphs from copyrighted materials and post them here on DU! Keep in mind, however, that public speeches by public figures are in public domain and are not copyright protected. Also, most info. off of govt. web sites are also public domain.
I'm glad to hear they went after FR--and WON! You just made my day!

The link is to a transcript of testimony given by Jim Robinson, founder of Free Republic. The testimony was for a copyright infringement suit brought by the LA Times against FR.
There's a lot of biographical detail in it, as well as an overview of how FR came into being.
