Last week, the Supreme Court issued its historic decision in Hamdan v. Rumsfeld. There, it dealt a substantial blow to the Bush/Cheney Administration's plans for the treatment of detainees at Guantanamo and, potentially, elsewhere as well - ruling out, for instance, the option of using military commissions without due process to try detainees.

The decision itself has been widely discussed. Less widely discussed, however, has been its backstory.

The Bush/Cheney Administration has been doing everything possible to keep its treatment of purported terrorist detainees out of the federal courts, particularly the Supreme Court. To assist the Administration, Republican Senators Lindsey Graham of South Carolina and Jon Kyl of Arizona engaged in a blatant scam that was revealed during the briefing of Hamdan.

Senators Graham and Kyl not only misled their Senate colleagues, but also shamed their high offices by trying to deliberately mislead the U.S. Supreme Court. Their effort failed. I have not seen so blatant a ploy, or abuse of power, since Nixon's reign.

To understand their ruse, a bit of background information about both the Hamdan case and the Detainee Treatment Act is necessary.

2. I heard about the Amicus brief but hadn't read Deans acticle.
I always enjoy reading his analyses of things. He explains everything very well!

This is the kind of actings you begin to expect from our elected officials....in the dead of the night, behind closed doors, not letting the voters really see what is going on. For Kyl this is the second "strike" in the last month of so....

Remember when Illegal Immigration was the issue of the day a few weeks ago. With the political pontification I saw, you would have thought John Kyl singlehandedly was "winning the war" on illegal immigration. He even said that the Federal Government has failed the state of Arizona on this issue......but, conveniently left off that he has been a US Senator since 1994 and a 4 term congressman prior to that. Doesn't that mean that KYL HAS FAILED ARIZONA?

Be that as it may...the repubs in Arizona stick to the numbers...and John Kyl has been named one of the 10 best Senators we have....WOW...To me that is not saying much, just look at the competition.

SAD REALITY: Kyl will be re-elected by the state in 2006...it is about as red as you can get and few pay attention to the important stuff.

5. Is there anyone of any worth running against Kyl?
In Virginia, Webb has a real chance against George Allen who has presidential aspirations.

Don't give up. Find a good candidate to run against Kyl.

7. Dems have a good candidate in Arizona...
Yes...The Democrats have a solid guy in Jim Pederson running against Kyl for the senate seat. Pederson is a successful developer in the state but has as record of civic service to go with it. Info on Pederson is at www.pederson2006.com .

The issue is that he has "democrat disease" in a highly repub state. All the Kyl campaign hs been doing is calling him a "liberal" and that is about all it takes. In addition to that, this whole thing about being "one of the top 10 senators" plays well with a voting population that goes to bed at 8:00pm and watches reruns of Larry King.

Some say the race is close...we shall see. Note that not even the state r-party will ask for Bush to campaign....

4. Very interesting article by Dean, thanks for posting!
Graham is as slimy as they come, I remember him strutting around during the Clinton impeachment hearings and as to Kyl, he is both slimy and stupid, imo.

And maybe not even then.

Post hoc additions of fake dialogue to the C.R. ...presidential signing statements that effectively are line item vetoes regarding presidential perogatives...

I've got to wonder just what sort of shit Roberts, Alito, Scalia, and Thomas are capable of cooking up.

If things don't change we are just about as fucked as democracy was in Mexico in 1940.
