BBC saying Minimum standards of the Geneva Conventions

All US military detainees, including those at Guantanamo Bay, are to be treated in line with the minimum standards of the Geneva Conventions. The White House announced the shift in policy on Tuesday, almost two weeks after the US Supreme Court ruled that the conventions applied to detainees.

President Bush had long fought the idea that US detainees were prisoners of war entitled to Geneva Convention rights.

The defence department outlined the new policy to staff in an internal memo.

1. This is Even More Important Than It Seems

This is obviously big and good news, but it's bigness and goodness may go beyond the obvious.

I've been wondering if Dear Leader would abide by the recent Supreme Court decision that he's not a dictator - after all, he's claimed that the Supreme Court has no jurisdiction over the President in "wartime"

This seems to indicate that Bush will abide by the courts. A very good thing.

2. SCOTUS said in its Hamadan decision, “On November 7, 2005, we granted

certiorari to decide whether the military commission convened to try Hamdan has authority to do so, and whether Hamdan may rely on the Geneva Conventions in these proceedings.

SCOTUS then concluded, “Common Article 3 {Third Geneva Convention} obviously tolerates a great degree of flexibility in trying individuals captured during armed conflict; its requirements are general ones, crafted to accommodate a wide variety of legal systems. But requirements they are nonetheless. The commission that the President has convened to try Hamdan does not meet those requirements.”
