1. Incredible arrogance on their part. They really thought they were
going to get away with it. And if we don't educate the right-wing Republican voters, they WILL get away with it, just like Oliver North did and the bald fool with the black moustache.

7. The SCOTUS doesn't have the means to enforce their decision.
The military, the FBI, the CIA, the NSA, the Marshal's Service and all other federal law enforcement entities fall under the executive branch, which means Bush/Cheney. And we all know they will not hesitate to use those entities in any way they want to.

If the past six years have shown us anything, it's that they don't care what the Supreme Court thinks, what congress thinks, what the American public thinks, or what the rest of the world thinks. They'll go after any public figure who speaks out against them and they'll be backed up by their corporate/media echo chamber.

When Bush said, "You're either with us or against us," the "us" he was talking about was a very small group of cronies, political allies and most of the super wealthy. As far as he's concerned, everyone else can go Cheney themselves.

Telling BushCo to obey the law is like telling a lion not to eat you.
