bush has claimed the right to spy on Americans and conduct warrantless searches and do anything else he damned well pleases because "we are at war" ...

imagine a case where a special prosecutor is appointed ... would this prosecutor report to the Congress? to the Attorney General? i don't know much about special prosecutors ... how would this work?

and imagine that bush or his staff is subpoenaed to testify and they refuse claiming executive privilege and national security concerns ... take it a step further ... imagine that bush is convicted by a grand jury or by the Congress or by any process but he refuses to accept the validity of any other authority other than his own ...

it is critical for Congress, even republicans in Congress, and the courts to weigh in on this matter ... if Presidents are above the law, have we not fully returned to the monarchy in opposition to which our country was founded? tyranny cannot be allowed to stand merely because we might suffer an occasional act of terrorism ... sometimes the medicine is far worse than the disease ... the first rule has to be "do no harm" ... the Constitution and the ideals of the country's founders must be preserved without exception ... this must not become a partisan issue; it must be presented, just as Gore presented it, as an American issue ...

2. There is no such thing as "above the law"
that's just a wimpy way of saying
"Bush is breaking the law"
or
"Bush is commiting criminal acts"
"Bush needs to be brought to justice"
"Bush needs to be put behind bars"

3. Special prosecutor reports directly to the AG.
The advantage we have with Fitzpatrick is that Ashcroft recused himself, so Fitz was appointed by the Asst. AG. I don't have a lot of hope for someone appointed by Gonzalles!

The rest of your "supposes" I'll wait and see if there is a SP, and take it from there.
