Edited on Tue Jan-17-06 09:28 PM by IndyOp
We only need 41 votes to filibuster. We can get 41 votes.
We only need 41 votes to filibuster. We can get 41 votes.

We HAVE Senators who will filibuster if they know they have the 41 votes.

Why we CAN win this fight:
> Committee vote delayed until 1/24 - after the Repubs had been promised a vote by 1/20.
> Senate Dems are sending Alito more questions and awaiting written response.
> Kennedy's staff said that all options are on the table.
> Reid's staff said today that he is trying to see if he has the votes to filibuster.

The Senators who might filibuster NEED OUR SUPPORT - to pressure moderate Dems and Repubs - ALL of them.

Remind them that history says that, in past, when Presidents had to make a 3rd nomination to SCOTUS the person was moderate! What will happen if the Alito nomination is blocked? History has an answer --

The Senators need to know that we are behind them if the Rethugs go nuclear: We will help them raise a stink about how the Rethugs are changing the rules in the middle of the game and link this behavior to all their other unethical behavior - it is part of the GOP culture of corruption. Keep calling them cheaters till they relent. (Hat tip to MomCat who called Senate Dems today and found they were interested to hear about this!)

1. Also mention that today Roberts sided with Scalia and Thomas in
the Oregon case which means that if they hope HE will be an O'Connor-like swing vote, they better reconsider!

2. Repeat After Me: Alito is NOT a Done Deal !!
NEW ACTION PAGE TO FILIBUSTER ALITO: http://www.nocrony.com

CALL YOUR SENATORS RIGHT NOW at 888-818-6641, 888-355-3588 or 800-426-8073.

NEWS FLASH: THE ALITO VOTE HAS BEEN DELAYED A WEEK. WE CAN WIN THIS!!!

We've noticed the most curious thing. Publically Alito's supporters state pronouncements that his confirmation is a "done" deal. And yet behind the scenes they are still lobbying furiously for a vote as quickly as they can get it. What do we make of this?

It's a con, folks. It's a great big, honking, corporate media lie. There is only one way the extreme right wing can win this one, and that is by discouraging the rest of us from speaking out. We'd have to be pretty stupid to go for that one, huh? We'd have to be total chumps, huh? Why else would anyone surrender a fight when they had the numbers to win?

And we do have the numbers. We are the majority. The president is back down to 39% approval rating and dropping again. And even if the majority did NOT oppose their radical dictator president agenda, all we need are 41 votes to filibuster. We HAVE 41 votes. We HAVE 41 votes. We HAVE 41 votes. All we need to win is to exercise the power we have, the will to win!

We'll make you a deal. For the next two weeks, we all repeat these words as a mantra

ALITO IS NOT A DONE DEAL

If you just do that, ALL of you, repeat it in your minds until it drives out the negativity, until it drives out the defeatism, until it drives out the despair, until it drives out the insidious right wing talking point which the cable TV propagandists have planted in our own minds. Just do that one thing, and we promise that we will deliver the victory for you.

59. My comments section
I don't understand the rush to confirm this Justice. If Senators on the comittee still have questions or are awaiting documents, I think general decency demands that you consider their views. This is not obstruction this is what was meant by advice and consent. If you really want bipartisan cooperation you have to give it. America deserves better!

9. Minds can sometimes be changed. Even at the last moment.
Besides, why do we care what they have announced? I don't call to find out what they think, I call to tell them what I think. Further - they should know how people feel and how much we feel it no matter what they decide. They should know exactly how out of step their behavior is in regards to their constituents, in regards to the nation.

Do we only act if we can win? I don't think that works. Winners put in consistent effort win, lose, or draw.

10. I emailed Specter about this
Edited on Tue Jan-17-06 09:27 PM by drm604
and received the following response. I'm sure that it's okay to post it here since it's an obvious canned response that goes out to everybody who expresses any opinion, positive or negative, about Alito. It's hard to know what to make of it.
Thank you for contacting my office regarding the nomination of Judge Samuel Alito for Associate Justice of the Supreme Court of the United States . I appreciate hearing your thoughts regarding this important matter.

I have known Judge Alito for the better part of two decades. He brings to this nomination a longstanding record in public service. For the past fifteen years, he has served as a judge on the Philadelphia-based United States Court of Appeals for the Third Circuit. Judge Alito has participated in thousands of appeals and authored hundreds of opinions. In his career, he has argued twelve Supreme Court cases and at least two dozen court of appeals cases.

Judge Alito attended Princeton University , and then studied at Yale Law School where he received high marks and served as editor of the Yale Law Journal. After graduation, he clerked for Judge Leonard Garth on the Third Circuit.

Following his clerkship, Judge Alito served as Assistant U.S. Attorney in the appellate division. In 1981, he became Assistant to the Solicitor General in the Reagan Administration where he argued on behalf of the federal government in front of the U.S. Supreme Court. Judge Alito then served in the Office of Legal Counsel as Deputy Assistant Attorney General where he advised the executive branch on constitutional matters.

In 1987, Judge Alito was unanimously confirmed as U.S. Attorney for the district of New Jersey. In 1990, Judge Alito was nominated to the 3 rd Circuit by President George H. W. Bush. He was unanimously confirmed by a voice vote of the Senate.

As Chairman of the Senate Judiciary Committee, I will ensure that Judge Alito receives a fair and thorough confirmation hearing. I believe that he is entitled to be heard, and I take the Senate's role in the confirmation process very seriously. Short of a declaration of war, the most important function of the United States Senate is the confirmation of U.S. Supreme Court Justices for lifetime terms.

Should you have any further questions, please do not hesitate to contact my office or visit my website at http://specter.senate.gov . Thank you again for writing.
Sincerely,
Arlen Specter

13. I just MUST apologize for my mistake about Alito.
Please, forgive me for believing he would neither overturn Roe or expand executive powers. It has become clear to me that, he is as vulnerable to the BFEE as Roberts and as a great a threat to the cohesion of what's left of our democracy.

He and his are obviously too wimpy to take a stand for the people's anchor in this democracy. They don't even identify with "the people" outside their circle of "elites", whether by birth or religion or politic.

I'm sorry.

47. I got to talk to Sam on air only -
If you were tuned in you would've heard everything. No 'scoop' for me to share beyond the points in my post above. I was writing the post while I was on hold, read key points from it on air, and finished it afterwards. I *wish* I had more to share... :hi:

they just do what's right and filibuster this lying Alito BushCo puppet...IT NEEDS to be done!!!

This is a win - win fight for the democrats...They have to fight and show America they will NOT lie down, this is far too important!

When, if not now...The Alito nomination must be filibustered, we have NOTHING to lose, it must be done to save our treasured Constitution!

Call Feinstein!!! INSIST!! Call every Democrat and tell them to fight and support the filibuster! It must be done.

55. Alito Filibuster -- Our Normandy in the Fight to Drive Out the Fascists!!
Edited on Tue Jan-17-06 11:27 PM by pat_k
Alito is emblematic of unlimited executive power.
The fight against Alito is our Normandy in the campaign
to drive out the Bush regime and the ever-expanding
dictatorial powers they claim!

The Choice

Prove Their/Our Strength, Conviction, and Courage
OR
Prove Their/Our Weakness, Equivocation, and Cowardice

"IMPORTANT NOTE: Due to recent security concerns, new mail delivery procedures have been implemented in the U.S. Congress which may significantly delay the delivery of mail and overnight delivery services to my office. You may continue to send correspondence to me via e-mail by using the webform found in the How to Contact Me section of this website. However, flag requests must continue to be sent via regular mail, since prepayment is required. Thank you for your patience during these delays.

We need to reach out to some of the Repubs too - not all of them are thrilled with Bush**'s imperial pretensions and invasion of privacy, which Alito would surely support.

Toles has it exactly right:

62. Done...
Thanks for this post. I wrote Senators Boxer and Feinstein (as their costituent) as well as Reid, Kennedy, and Feingold, and I signed the petition. I will call tomorrow as well.

After watching MY PRESIDENT, Al Gore, speak with such eloquence and passion yesterday, I am called to greater action. He told us in no undertain terms that the time is NOW, and I heard him loud and clear. I heed his call. If we want OUR country back, we must take it back. We must hold to the fire those we've elected to represent us, and not back down.

Thank you, again, IndyOp, for this post and for spreading the word by calling in to talk with Sam Seder about this. You've helped to give me a current focus for what my heart feels compelled to do.
