Couldn't Fitz look into the NSA spying scandal?

During the days of the Clinton Administration, it looked like every time we turned around, Ken Starr was exerting his right as a special prosecutor to look into whatever floated his boat about Clinton, which is how we really wound up with Monicagate.

Couldn't Fitzgerald use the same tactics to take on investigating the NSA's illegal spying? Why wait for Gonzalez to appoint a new special prosecutor; let him pull a Starr!
