If they were really going to filibuster
you wouldn't have Senators coming out and saying they were voting against him. Intent to vote and filibustering are in conflict. Tomorrow Senator Leahy is making a speech at Georgetown and will reveal how he's going to vote. And as for joementum? In one breath he says he's open to filibustering, and in the next he says he hasn't decided how to vote. What sense does that make? It's rhetoric. Persuasive speech. He's speaking to his constituents because he's facing a primary challenge from his left. I think it's pretty clear that they'll hold the vote. Most dems will vote against Alito, but a few will probably cross over and vote for him.

2. Well, that could be a good sign and he could be playing his vote.
We'll see.

The poster has a point on voting yes versus fillibustering. We need to be hearing the word "fillibuster". We don't need to be hearing about them voting "yes".

4. I disagree - if they have 41 "No" votes then they can filibuster -
It takes 60 votes to overcome a filibuster - so long as we have 41 "No" votes then the filibuster is on; the only way to end it is to agree to pass on Alito...

5. This isn't necessarily true
There could easily be several Democratic senators that would feel comfortable voting to invoke cloture, but oppose the nomination.

Remember, Clarence Thomas was confirmed 52-48, and there were 56 Democrats.

6. Voting to invoke cloture is just a strong "No!" -
If you are really adamant that he not be seated on the Court then you feel strongly enough to vote against cloture. Right?
