Following yesterday's meeting of Senate Democrats, a consensus to fight Alito's nomination is emerging, but a final strategy has not yet been decided.

We can't tell you what will happen today or tomorrow, but we can tell you that your activism has had a real impact in this critical time and will continue to. Thanks in part to the thousands of calls you poured into Senate offices yesterday, senators are becoming more vocal in their opposition to Alito. Just today, senators off the Judiciary Committee -- including Max Baucus, Tom Harkin, Barbara Mikulski, and Ken Salazar -- have announced their opposition to Alito.

Today three members of the Committee -- the Committee's Democratic leader, Senator Leahy, and Senators Kennedy and Durbin -- are announcing their positions in speeches around the country. Normally such statements would be made on the Senate floor, but in a move that has wrankled many Democrats, the Senate's Republican leader, Bill Frist, has already moved to limit debate by denying them time to speak in the Senate chamber.

If you haven't called your senators yet to let them know you're counting on them to stop Alito, please do so right now. If neither of your senators is a Democrat, call Democratic leader Harry Reid or the Judiciary Committee's top Democrat, Patrick Leahy.

These are definitely special circumstances. The Bush Administration is openly trashing the constitution while stacking the court with true beleivers in their radical agenda. The vote on Oregon's Death With Dignity Act is a clear indication of how the Bush Bloc will vote on issues that affect us all. Vote no on Alito and stand prepared to fillibuster his confirmation.

Durbin's attempt to rationalize half-measures (post #10 below) are frustrating, but it can also be viewed as a positive sign.

When they start with the rationalizations and excuses, it usually means we are getting through. They wouldn't need to grasp at straws to justify dereliction of duty if they weren't beginning see what they are obligated to do.

moral imperative!

When you make contact, let them know it is ALL THE WAY or NOTHING. The choice that faces the Democratic Caucus is simple: Filbuster and fight to the end with pride or turn away from their moral obligation in shame.

Durbin made some comments (link below) -- he's already rationalizing half-measures.

Whatever they might think, voting "no" and speechifying IS NOT ENOUGH. Believing that anything short of an all out effort "matters a lot" may quiet the voice conscience and ease the shame, but it does not change the reality of their failure to do the right thing.

19. Yes, call Mr. Apology, too -
And, maybe, remember that in past he called Bush a loser and a liar - when confronted by Rolling Stone about that, he apologized for calling Bush a loser, but said that he would *not* apologize for calling him a liar.

Also - he got his statement out there - getting the connection between Republicans and the mob out there is good work and it will have far bigger effect than the apology, IMO. The incorrect story appears on the front page of the Times and the correction appears 3 weeks later on an interior page next to the sports section.
