This is the dreaded scenario we've been waiting for, direct violation of the Constitution as ruled by the Judiciary, with the Executive branch claiming the rights of the Judiciary branch for itself. Unless he gets a stay from a higher court, failure to comply pretty much enters the realm of overt dictatorship, correct?

...if they take the case. If the appeal fails, then the Supreme Court is the Admin's last shot. If that were to happen well, KEnnedy has proven to be no friend of the current establishment. I think he will rule in favor of civil liberties like he has in the past.

17. Nobody, sadly
The judiciary has precious little actual power over the executive, since it's the executive that would have to actually send agents to enforce the ruling. See also Andrew Jackson's infamous refusal to follow the court order preventing the removal of Native Americans to the west.

“In the ongoing conflict with al-Qaida and its allies, the president has the primary duty under the Constitution to protect the American people,” the department said. “The Constitution gives the president the full authority necessary to carry out that solemn duty, and we believe the program is lawful and protects civil liberties.”

White House spokesman Tony Snow said the Bush administration's “Terrorist Surveillance Program” is “firmly grounded in law and regularly reviewed to make sure steps are taken to protect civil liberties.”

The ruling won't take immediate effect so Taylor can hear a Justice Department request for a stay pending its appeal.
