A Legal Opinion May Put Damper On Impeachment

WASHINGTON -In a reversal last week, Washington's town counsel, attorney David Miles, advised the Board of Selectmen that it is not obligated to allow a special town meeting on a resolution calling for the impeachment of President George W. Bush.

The new opinion represents a shift in the advice of Mr. Miles, as cited two months ago by First Selectman Dick Sears, who said the attorney deemed a petition calling for a town meeting legal.

In June, an informal group of citizens petitioned the board to hold a special town meeting for the purpose of discussing and voting on a resolution calling for the impeachment of President Bush and Vice President Dick Cheney.
The resolution would be based on a specific set of alleged offenses, including that the president subverted the Constitution, and its proponents envision seeking to have Washington's call for impeachment travel up the governmental ladder until it reached members of Congress with the power to initiate impeachment proceedings.

At that selectmen's meeting, Mr. Sears said he had spoken with the town attorney, who offered the opinion that calling such a meeting based on a petition was legal and an obligation of the board. The board must call a meeting when a petition signed by 20 or more citizens is brought forward, unless it can deem the request "unlawful, frivolous, and/or improper."

The local petitioners' efforts are part of a national grassroots movement where municipalities are passing resolutions calling for the impeachment of the president. Cities and towns in California, Vermont, New York and other states have passed similar resolutions. To date, no municipality in Connecticut has passed a resolution on the matter.

Mr. Cornet said the group is tentatively planning on re-petitioning the Board of Selectmen in September.
