the word here is might or may. This isn't a strong enough word for the American legal system. as terrorists will blow you up regardless of whether they have been surveilled.
A law was broken by the Bush administration.

whether it works or doesn't work. Nobody is saying they shouldn't wiretap - what we're saying is they shouldn't wiretap without a warrant.
Have to believe whatever "they" are doing is SO OUTRAGEOUS that they would not get a warrant - because otherwise not getting one makes no sense. It is incredibly easy to get FISA to agree to these things - unless like I said what they are doing is so outrageous. And given their track record that is exactly what they are doing.
