Resolution Endorsing House Bill 4717 State Representative Patricia Reid-Lindner has authored HB 4717
which will require railroads to obtain certificates of public convenience and necessity prior to exercising
eminent domain. This in turn will require public hearings before the ICC at which local county officials would
have the opportunity to express the concerns of the county and its residents. Committee was asked to support
the Bill. Sandner said at present the railroads have the right of condemnation of anything that's consistent with
their stated purpose. The county would rather they be required to hold public hearings so that the county could
have an opportunity to express its wishes. DeKalb County has already passed a resolution of support. Van
Overmeiren raised the question of federal authority. Sandner said this will allow pre-emption in some areas and
