Big question I suddenly thought of regarding Alito...

Big question I suddenly thought of regarding Alito...
It concerns those stellar recommendations he's gotten, most specifically from the American Bar Association. Several Republicans have cited that as a reason to vote for him. I don't know the process that the Bar Assoc. uses to make recommendations...

So here's my question: the issue that is thorniest regarding Judge Alito's philosophy is how he might decide Constitutional issues involving balance of powers (yeah, I know there are tons of other issues, but if his decisions were to undermine the Constitution, those other issues would pale in comparison). So, how could the Bar Assoc. rate him in this area? Has he ever ruled on issues involving Presidential power? I don't think he has. I thought it was only the SC that ruled on such issues. So, if I am correct, that Bar Association recommendation means very little in this regard, right?

I guess in other words I'm wondering if it's essentially a rating leaving out one of the most important issues that we need to know about him.

1. also, if any of these lawyers come up before him
don't you think he might tend to rule in their favor since they sucked up to him so much by extolling his virtues?

3. I think it would be hard for any attorney to testify *against* him,
wouldn't it? It would be seen as bad form, I suspect. The confirmation hearing was "handled" imho.

4. the lawyers aren't supposed to testify to begin with
they volunteered--they wanted to be there--which is something that doesn't usually happen from my understanding
