I was thinking the dems would want one because Leahy thought his remarks were going to be AFTER a 10 min debate on the border fence - he was pissed about that. It looks like they changed the order a bit so maybe they are just buying some time to get shit together...but it was McCain if Im not mistaken that called for the quorum

They are doing what they can to protect their asses from war crimes prosecution. It won't matter though once Dems have subpeona power next session.
Plus, the rationale is all wrong. One could say "Saddam Hussein, as the executive, defined Article 3 as he saw fit". Did that make Bush say, "oh, he's not a dictator then, he's not a war criminal"? No, of course not. If the international community view this president for the war criminal that he is, it will not matter what our federal law says. What matters is how the international community interprets Article 3.

I have work to do... but I feel it necessary to stand witness - mute, gagged witness, but witness nonetheless, to the destruction of everything America is.
It's not just legitimizing torture, it's not just gutting habeas corpus. This vote essentially gives one man the right to disappear and torture anyone he wishes to, and provides no check or review by the people or the courts of that power. That, in my opinion amounts to the destruction of America.
Therefore Bush's rallying cry of the last five years has come to pass. The terrorists have won. They have destroyed America.
I stand witness.
