If Alito is confirmed RoeVWade would still be 5-4 in our favor |
|
Although Kennedy swings a bit because he has supported RoeVWade when cases came to the court that tried to overturn it; however, he has also supported limits on abortions when he supported CaseyVSoutheast PA Reproductive center which allowed parental notifications and wait-periods
But right now the court stands like this:
For RoeVWade: Souter, Ginsberg, Breyer, Stevens and Kennedy* (see my comments above) Against: Thomas, Scalia, Roberts (I'm assuming we don't know yet) and Alito (if he makes in on the court)
That doesn't mean we should slack off, but just pray really hard that Souter, Ginsberg, Breyer, STevens and Kennedy all stay healthy as can be!!!

1. Although it sounds like Alito would vote to overturn it, I'm not so sure |
|
about Roberts. Souter surprised us all by being a liberal, Roberts could surprise us all by being a moderate.

4. Well I'd rather assume for the worst |
|
which means I'll fight to keep Alito and others like him off the bench. I didn't care about Roberts because he was replacing Rehnquist which was a wash. But this Borkalito is replacing a true moderate (ok except for that Bush V. Gore thingie) and that upsets me!

The road to overturning Roe Vs. Wade isn't a clear straight line, at any rate. Bryant Check it out --> http://politicalcomment.blogspot.com

3. It occurred to me this morning while driving to work |
|
that Kennedy now really becomes the swing vote. I hope that he realizes the importance of his position now.

5. But the babies that live will have no civil rights! |
|
They aren't worried about the black babies anyway.
They only care about keeping the White population up so they can stay in power.
Diebold will take care of all of that for them.
Note: Souter may quit after they try to take his property. I wonder if Rove is behind that one.

7. The thing is; Roe v. Wade isn't our only concern |
|
unchecked presidential and corporate powers could make the situation in this country far worse than it already is if Alito is confirmed.

8. The reasonable justices are very old and have had serious health condition |
|
We have to hope they can last through the Bush term. This is very dangerous!

9. I read somewhere that Kennedy tended to follow O'Connor. |
|
Edited on Tue Jan-24-06 11:40 AM by PatsFan2004
He was persuaded by her arguments. Without O'Connor, Kennedy may follow the most persuasive and thoughtful of the justices. Roberts may be that judge since he was able to express himself in the hearings in such a manner as to persuade DEM votes for him even though his wife is anti-abortion.
None of the other justices have this gift of "persuasion".

10. But how would the court break down on |

the issue of constitutional checks and balances and constitutional rights? Or is that to be considered as a reason to disprove or approve of his nomination?

12. Not to be Machiavellian about this |
|
But if the Repukes get rid of Roe v. Wade, that would be the end of their party. The moderate Republicans, who are still a large chunk of their voters, keep saying "oh, that's just a few nuts." It's not, it's the majority of their party, but if they get their way, most moderate GOP women will never vote Repuke again, and young women will be turned off the GOP for decades.
Roe v. Wade would still leave abortion safe and legal in the blue states. Let the red staters find out what life is like without abortion as an option.
