When a matter goes beyond a jury, the attorneys are concerned with credibility of the witnesses. When it goes before a judge, a lot more emphasis is put on the facts. Who are we going to believe? Scalito refused because he said that 4 consecutive white juries = 5 out of the last 6 Presidents being left-handed. He equated it to that.
