Now This Is Setting Up A Constitutional Crisis --Very Scary.... |
|
(I posted this in response to another thread, and after thinking about it decided to post it as OP with a few additions and alterations)
When the Legislative and Executive Branches decide to ignore the Judicial Branch's interpretation of the law and constitution, we will find ourselves in the midst of a full blown constitutional crisis and in danger of entering dictator territory.
The rule of law will cease to exist. The Constitution will cease to have primary authority, and the unfettered power of this country will reside in a President and limited term representatives who received huge campaign contributions to get elected. All hopes of a government based on checks and balances between the three branches will disappear, and separation of powers will cease to exist.
This is how revolutions and coups are started. People with political power change the rules, ignore the rule of law, and install their select individuals with power to rule --but without the legitimacy of the people.
The SCOTUS has been packed by Repubs, and they have given Repubs almost everything they asked for, and this is what they get in return. If the SCOTUS does not confront and reel in the out of control Repubs, the SCOTUS will be marginalized and the President will become the dictator he always wanted to be. It is now time for the SCOTUS to stand up to the threat and preserve at least a semblance of the country our founders intended.

1. No crisis. They are gonna do what the want when they want. Period. |
|
No crisis unless one branch stands up for the Constitution.
Ain't gonna happen without a lot of pressure.

2. fascists have at least 3.5 votes for dictator: Scalia, Alito, Thomas, and |

maybe Roberts.
Alito refused to endorse checks and balances and the co-equal branches of government principle during his confirmation.

4. Ultimately, that is the situation we find ourselves in. |

This goes so far beyond how a lot on the right see it. Many Bush supporters see this in two simple ways:
1) The President now has the "tools" he needs to fight terror so he may protect America 2) This nonsense that we shouldn't trust Bush is just Liberal partisan politics
First, the ultimate goal of fighting terror, as they (the right) claim, is to protect America. The problem is that the America Bush swore to protect, he has just dismantled. The only thing left to protect is his power over it. He has dismantled a functioning government with checks and balances of power which puts the US Constitution into serious jeopardy of being all but eradicated. He didn't do this alone - Congress, our elected representatives helped him and pushed along what Bush placed into motion.
Secondly, as things stand now, we have no choice (beyond trying to reverse this legislation) but to hope we can trust Bush. Read that again. We have no choice now but to hope we can trust George W. Bush with his new found, practically unlimited power.
Our trilateral system of government was designed under the premise that we can NOT trust one branch with all the power. It was designed to prevent even two branches to obtain all the power.
Our only hope is that the very branch of government that put him into power, the Judicial, can take him out of power. Short of that, we may be witnesses to the end of the traditional system of American government.
