12. Remember what happened to the Patriot Act just last month.
All of the Democrats sat around on their hands until Russ Feingold said he would filibuster no matter what. The groundswell built until even Republicans were voting against cloture.

Of course, there was also the time the Democrats needed one Senator to sponsor Gore's recount, portrayed famously in Fahrenheit 911. And not a single solitary Democratic senator would come forward.

For Kerry to do it, he would be stepping outside protocol, and that would really piss off Judiciary Committee members.

When Kerry signalled he would support a filibuster, that should have emboldened committee senators that they would not stand alone.

http://www.cnn.com/2006/POLITICS/01/24/alito/index.html has this paragraph- Democrats have all but dismissed any attempt to filibuster the nomination. But several on the panel used the vote to attack the president's policies.

We should remember that this is CNN though. This report was really to say Alito passed the committee and is now going before the full Senate for a vote.

if they don't. Oh, and third party here I come. If I'm going to waste my vote on Democrats that do nothing I may as well waste it on a third party and at lease have someone who has the balls to stand up to these thugs, guaranteed loser or not.

I'm close to abandoning the Democratic party since they seem to have abandoned me.

If they fail to filibuster, it will be the final straw. "Independent Underground" here I come! ;)

34. It's a vote
They ask for cloture and vote. I think you even have to have a certain number of senators to get the cloture vote to start with. One person doesn't do filibusters anymore, unless they're going outside the general rules of the Senate.

The rumor is now that the Dems won't do it, which is smart, because if a Filibuster is to be effective, we can't give the Wingnut media time beforehand to "frame" the filibuster the way they want to. Never give the Rethugs a fair warning, or a chance to spin it.

The best way to do a Filibuster is to tell no one that you're going to do it...make people think you're not going to do it....then, the moment the Senate gets to the voting, FILIBUSTER!!!! Then go all in, and never let up. Surprise them.

Wait and see....that's what I would do.

i have called all the gang of 14 and every other dem and jeffords. in no one's office did a staffer seem upbeat. not one. in my many years of activism, the affect of their voices is telling. i will keep on trying using my bread money for phone bills.
