DoD is preparing its appeal to the 2nd circuit. I've heard some time in March as their first court appearance.
It'll be resolved at this level, given the precedence for no FOIA's making their way past this level.
Either it will be kicked back down to hellerstein's circuit, dod will win, or ACLU will win. IE. no FOIA requests have made their way to the supreme court. Apparently the appeals court could send it back down on some grounds that are beyond my legal knowledge, restarting the clock again.
It's been written by some legal-expert sounding Kossacks over at dkos, that the findings from Hellerstein were such a strong rebuke of the DoD's defense, that it will be difficult for the appeals court panel/judge(?) to ignore his rather detailed and long decision. That's a good thing. But we'll see. I'll poke around the diaries at dkos to see if there are any updates.

I'm as cynical as the next guy, actually alot more.
Sure our US justice system has it's flaws but cases don't just disappear because bunnypants and the rumsfilled wants them to. The way they fight this is to stall the clock out, with procedural chicanery. The wheels of justice grind ever slower but I have confidence that this case will eventually be resolved.
We may not like the outcome, but this is not just some scandal, it's got a docket number,it's searchable on CourtWeb, and Judge Hellerstein issued a decision that was heavily favoring the ACLU's case.

It'll be interesting once the appeals court decision comes down. Because if the court supports the ACLU, I think Bush will try to defy the order. They've had a horrible record w/releasing FOIA documents, and these photos would be devestating to his regime if they were released. It could really become a constitutional showdown.
