4. looks like a copyright violation to me
you can't just take a person's likeness, name, and work, and steal it. ferchrissakes.

7. It's done all the time
The standards are different for "public figures" when it comes to proving slander and libel.

10. not talking about slander and libel. copyright
means that jon stewart and the daily show own their images, names and concepts. you cannot just steal them. copyright has nothing to do with parody, or slander.
this is stealing, sorry.

12. it's like this- you can be weird all yankovich,
making fun of people, making parody songs, but you can't call yourself john lennon, sing beatle songs, and otherwise pretend to be john lennon. copycats are not parodists. they are thieves.

13. Fans create things like their own version of the JK Rawlings (sp?)
stories with her characters. It's called "Fan art", or whatever.

I think it is only a legal problem if there are sums of money being made off of the work. Not 100 % sure though.

14. nope
legally, making money doesn't have anything to do with it. practically, probably no one is going to go after someone who is not making any money.
but as a creative person, i have to speak up about this kind of thing. i have been ripped off plenty, but i don't have the resources to track it down. jon stewart, on the other hand...

15. From the reading I've just done, some of the copyright holders
like it and some don't.

But you are correct about the money, it doesn't matter if there is no income garnered from the work.

However, hsher's piece on Tucker Carlson and Ann Coulter is definitely satire and commentary.

16. Sweet!
Btw, I had to meet with my attorney this morning because I'm owed $10,000 by the producers of "Monster's Ball", and I mentioned IGNORED and her comment to him. He looked at the Leibowitz site and now knows what IGNORED said. The attorney says not only is Your Morning Leibowitz NOT copyright violation, but now it turns out calling a produced artist's work "stealing" may itself be libel. He is an entertainment attorney, fully licensed and on the state bar. I've taken care of the problem with a tidy little letter. But let all read the proclamation: hear ye, hear ye:

YOUR MORNING LEIBOWITZ IS NOT COPYRIGHT VIOLATION OF THE DAILY SHOW.
PUBLIC FIGURES ARE EXEMPT EXCEPT IN THE CASE OF LIBEL.
IF I WERE BROADCASTING A TELEVISION FAKE NEWS SHOW CALLED THE DAILY SHOW,
THAT IS CALLED *TRADEMARK* VIOLATION.
IF I WERE CALLING MYSELF JON STEWART AND SPEAKING ON THE COMEDY CIRCUIT
REPRESENTING MYSELF AS JON STEWART, THAT IS *PRIVACY* INVASION.

In short,

PUBLIC FIGURES + SATIRE - LIBEL = LEGAL.

Any questions, contact your local entertainment attorney.
And PLEASE:
Go tattle to Stewart and The Daily Show; maybe I'll get the hookup like that guy Avery who started ColbertNation.com -- ***without Stephen Colbert's permission.*** (And the rest was history!) Run, run, go tell him. Go. Run, do not walk. PLEASE. Publicity costs money. IGNORED'S is free.

8. Public figure + satire - libel = legal
Jon Stewart does it to Bush, other politicians, and various celebrities, every night on, um, The Daily Show? A public figure cannot prevent works of satire being created and/or published about them or using their likeness unless the material in question is an act of libel.

<--- works in entertainment industry
<--- has entertainment attorneys
<--- checked it out first
<--- legal "satire" disclaimer on site

But genuinely, no sarcasm intended, thanks for your concern.

8. Because nobody's done THIS yet
:::New York and Washington, DC, taxi cab drivers boycott FOX employees::::

FOX employees in New York City and the Beltway depend on cabs to get to and from their bureaus. This is especially the case in New York. As retaliation for the "Mark Foley (D)" propaganda attack, I call upon the cab drivers of New York and Washington, DC, to boycott FOX employees and refuse to transport them. Indefinitely.

NEW YORK:
If anyone gets in your cab requesting Sixth Avenue and 48th Street, or surrounding areas within a three-mile radius, refuse to take them there.

WASHINGTON:
If anyone gets in your cab requesting Third Street, or surrounding areas within a three-mile radius, refuse to take them there.

This will have an immediate negative effect on FOX News broadcasting because it will damage writing, staff meeting and broadcast schedules. Regular citizens who don't work for FOX may get caught in this boycott dragnet, but ist tut mir leid. Find another way to get where you need to go. The FOX punishment boycott needs to start with the taxis. The next step is for regular wage workers at the services FOX employees and their families enjoy to refuse to serve them and refuse to sell to them: even on punishment of termination of employment. If you are fired for not serving a FOX employee, then spend your free time distributing leaflets containing anti-American FOX literature to your replacements as they arrive. Stand just off employer property to do so, on county-owned right of way. Usually that is the sidewalk or just inside it ("outside it" is the street). Inside includes varying widths of asphalt or grass. If necessary, distribute leaflets translated into Spanish about FOX News sympathy towards the Minutemen and their activities.

Turn this nation back around.
Time for the drastic measures.
I'll be back with more ideas later. Feel free to copy, print and distribute this.

Yer Daily Show comic strip

(emphasis mine)

Estimated to cost the city of New York and its citizens several billion dollars, but guaranteed to destroy Faux News (and ABC, NBC, CBS, and CNN since they're all included in the three mile radius).

Thank G-d I'm a liberal!!!!! Have you ever just felt that? *Can you imagine being conservative?*
How lucky are we?

Thanks for the kick! I intend to use this comic to make Jon say the stuff he's too careful to say and ought to be saying. He's a great leader for the left, yet he's so careful. Let's see him get a little LESS careful!
