The Great American Cockroach Check

Is your current or former employer's pension plan infested with Cheney-sized cockroaches? Here's how to tell:

1. Look up the annual Form 5500 for your current and past employers' pension plans on FreeERISA, using their free search tool (free registration required): http://www.freeerisa.com/5500/Form5500.asp?mode=SEARCH

2. Remember that your company's plan may be under some variation of the corporate name. For example, IBM might be under the full, spelled-out name, instead of the acronym.

3. Once you have located your plan's latest Form 5500, note the Quicklinks at the top of the filing, which includes the "schedules" that your plan is required to file. If your plan shows a Schedule C, this will list out the fees paid to "service providers". Look for State Street, State Street Bank, SSB, State Street Global Advisors, and any variant of "State Street" or "CitiStreet". If your plan shows a Schedule P, this should also list the entity that serves as trustee of your plan.

Now, why would you care if State Street or CitiStreet is charging fees to your fellow plan participants / retirees drawing from their share of the plan?

Here are a few reasons to care:

1. State Street is currently fighting the Polaroid families who lost everything. Even though two Polaroid directors interlocked with State Street's board of directors, State Street waited until Polaroid stock was trading for a dime - and the retirees started to organize to have a say in the company's bankruptcy proceedings - to finally unload the plan shares. This is made all the more heinous by the fact that the Polaroiders had no choice but to buy the shares: they were forced to particpate in the leveraged ESOP: http://www.google.com/search?hl=en&q=polaroid+esop+%22state+street%22. 2. State Street was handpicked by Elaine Chao (Secretary of Labor and wife of Senator Mitch McConnell) and Eugene Scalia (Solicitor of Labor and son of Antonin Scalia) to become the "special fiduciary" for the Enron employees' pension plans, after Kenny Boy Lay got caught. Now why would Chao and Scalia pull out all the stops to have State Street appointed as their chosen fiduciary? Remember the Enron commercials that asked: "Why? Why? Why?" Well, the answer is simple: Andy Card's high school pals are Ron Kaufman (the architect of the Willie Horton ads) and Ron Logue, Chairman and CEO of State Street. In fact, these three hooligans all hail from Holbrook, Massachusetts, where the plot is already under way to annoint Mitt Romney as the next GOPuppet. The Bushies were terrified in late 2001/early 2002 that the full extent of Kenny Boy Lay's misdeeds would get out, so State Street became the trusted BushCo. "fixer firm," to help identify would-be ringleaders among the Enron pensioners, and to keep them placated through November 02.

3. Ah, but the best laid plans of mice and men, right? In an attempt to stick it to its rival, Northern Trust of Chicago, Boston-based State Street told the Enron Employees' legal counsel, Keller Rohrback LLP, certain "dirty little secrets" of the private pension industry. Imagine the collective sense of panic at State Street, when Keller Rohrback showed up as the POLAROID Plaintiff's counsel in their class action. State Street tried to get Keller Rohrback thrown off the Polaroid case, on the basis that Keller Rohrback would now be able to use its newfound knowledge of these dirty tricks against State Street. 2. What to do if your plan has a State Street infestation...
1. Do NOT call up your HR/benefits group to complain. Remember: they likely played a key role in selecting State Street. In most cases, they were probably unaware of the issues. All that slick marketing that State Street does - "we service 'sophisticated' investors" - is aimed at making plan sponsors feel good about their choice. That said, nobody likes to get an angry call saying, "You've made a bad decision here."

2. Rather, DO call up your Senators and local Member of Congress. Politely but firmly insist on oversight hearings. Explain that you are a constituent, and that your plan sponsor (employer) is headquartered in, or has significant operations in, their State or Congressional District.

3. If you are so inclined, send me a private message with: 1. the name of the plan(s) affected (be sure to check your current employer's plan, as well as any prior employers where you still have money parked in their plan); 2. the State and Congressional District of the company's/companies' headquarters; and 3. if different from 2., the State and Congressional District of the company's operations where you work. Once I have 100 of these actual constituents' plans, I'll post (and regularly update) a three-column table, listing this information out for Senators, MCs, and their staff. FreeERISA makes it easy to locate plans by zip code, but it will have a greater impact to confront lawmakers with *actual* constituents' cockroach checks. "This is a list of plans in your State/District where *actual* constituents have already confirmed that their plan is affected. On top of this list of *actual* constituents who have already checked, here's a much longer list of affected plan sponsors in your State/District, who may not yet know they are affected."

That way, as the story breaks, your company's HR/benefits folks will hear about it, and then check into it themselves, without shooting the messenger (you) for confronting them about it.

David A. Smith, the whistleblower that State Street has tried - unsuccessfully - to silence, is a 1990 recipient of the Lorin E. Kerr/UMWA Scholarship?

This track record put Fink's name on the grapevine as a possible successor to Philip J. Purcell after the Morgan Stanley (MWD ) CEO said on June 13 that he planned to retire. Neither Fink nor Morgan will comment, and many other names have also been floated for the job.

There's no doubt, though, that Fink, 52, isn't satisfied with being just a bond titan. He'd like BlackRock to be famous for equities, too. So in January, BlackRock, which is 70% owned by bank-holding company PNC Financial Services Group Inc. (PNC ), shelled out $375 million to buy MetLife Inc.'s (MET ) State Street Research & Management. The deal added $50 billion in assets, including $17.6 billion in stock funds. And he has also worked to turn around a family of ailing stock funds that BlackRock bought in 1998 from PNC -- at PNC's behest -- by poaching top fund managers from rival firms.

After his success in bonds, why would this Master of the Universe want to plunge deeper into risky stocks? Partly, it's for diversification -- bonds won't be hot forever. Clients are clamoring for more equity, he says. And, as Fink puts it, "maybe that's where my hubris lies."

LEFT BEHIND
Boosting the stock side, which makes up 8% of BlackRock's $400 billion in assets, has been a struggle. The BlackRock Large Cap Growth Fund underperformed 90% of similar funds during the 2000-2002 bear market, says Morningstar. BlackRock's Small Cap Growth fund trailed more than two-thirds of its peers in the same period. State Street's two biggest funds, Aurora and Investment Trust, also have had mediocre returns in recent years.


There are some major red flags in this article .. to put it mildly.. "underperformed 90%" - WTF??? and yet the article makes Fink look like he's equivalent to the second coming of Christ..

Signature is the assignee of the '056 patent which is entitled "Data Processing System for Hub and Spoke Financial Services Configuration." The '056 patent issued to Signature on 9 March 1993, naming R. Todd Boes as the inventor. The '056 patent is generally directed to a data processing system (the system) for implementing an investment structure which was developed for use in Signature's business as an administrator and accounting agent for mutual funds. In essence, the system, identified by the proprietary name Hub and Spoke®, facilitates a structure whereby mutual funds (Spokes) pool their assets in an investment portfolio (Hub) organized as a partnership. This investment configuration provides the administrator of a mutual fund with the advantageous combination of economies of scale in administering investments coupled with the tax advantages of a partnership.

State Street and Signature are both in the business of acting as custodians and accounting agents for multi-tiered partnership fund financial services. State Street negotiated with Signature for a license to use its patented data processing system described and claimed in the '056 patent. When negotiations broke down, State Street brought a declaratory judgment action asserting invalidity, unenforceability, and noninfringement in Massachusetts district court, and then filed a motion for partial summary judgment of patent invalidity for failure to claim statutory subject matter under § 101. The motion was granted and this appeal followed.

Sep. 14--It has been a profitable ride for St. Petersburg's Signature Bank, which has hitched itself to the real estate rocket of the past few years.

Eighty percent of its loans are in real estate, mostly commercial loans financing offices, shopping strips and housing developments.

So when the Federal Reserve and other regulators proposed tightening standards for such loans, citing potential volatility in the property market, Signature shot off a letter of protest. So did about 20 other lenders in the Tampa Bay area.

"It looks like my employer (American Airlines) has a variety of plans ALL administered by State Street (flight attendants, pilots, hourly employees, etc)

Most curious though: ALL except for ONE...THE SUPPLEMENTAL EXECUTIVE RETIREMENT PROGRAM SERP FOR OFFICERS OF AMERICAN AIRLINES is admisitered by Wachovia.

So what do you make of that?"

To paraphrase my response:

1. There are several plausible reasons that the American Airlines executives chose Wachovia instead of State Street. Perhaps Wachovia did a better job of bidding the business. Perhaps Wachovia is better-known for giving first-class service to so-called "top hat plans".

A couple tidbits since we're making some archive material.

So basically, in 2000 and 2001, they took $7 trillion out of the US stock market. There was a lot of bulls**t about "the tech bubble bursting." Who precisely lost that money? Well, looks like a lot of "uppity" bourgeoisie to me. Not to mention probably darn near the entire population of IT folks, who now are working either at jobs that pay about 1/3 what they used to, or aren't even in IT any more. And since everybody even in "old economy" businesses had to get computerized in order to compete, let's see now, precisely who benefitted from that? And of course, they "offshored" it. One of the funniest stories of the 2004 election was how someone got a call for donations from the Reprehensibles- and it turned out to be Amit- and you guessed it- the Reprehensibles OFFSHORED THEIR FUNDING DRIVES!

OK, we already had brief parts of "how was it done." I read a post where there was discussion about the DTCC, and who precisely owns it- surprise, State Street is on the list of outstanding shareholders. I have found articles that state that there are $6 billion in "failed trades" a day. Let me say that again, $6 billion PER DAY. A guy bought all 1 million plus shares of stock that were outstanding for a particular company, and put them in a sock and hid it under his bed. He looked at the stock market and found that HIS SHARES HAD BEEN BOUGHT AND SOLD AN AVERAGE OF SIXTY- 60!- TIMES EACH SINCE HE HID THEM!

This is counterfeiting on a MASSIVE scale.

That's the first tidbit.

Now let me ask you a question:
First they took the S&Ls.
Then they took the Stock Market.
What's next?
Can you say, "$50 trillion from the housing market?" I thought you could.
Read anything Greenspan said about the housing market? The writing's on the wall, people.

old mainframe programmer, but doing great until 2001. lost money in the stock market, then lost my job - outsourced to cheap foreign labor. And now my company pension is sending fees to State Street and CitiStreet.

Bear in mind that the human factor comes into play here. Whoever fills out the Form 5500 may use abbreviations, such as SSB, and - as you can see from the subsidiaries list - most of the related entities include State Street as the root.

Oh, yeah: SSgA or SSGA - the acronym for the asset management division of the company, "State Street Global Advisors," is another one you'll find a lot.

If Bob Woodward wasn't one of the reporters nosing around about the Andy Card / State Street link in April of this year, then all he has to go on is what his White House sources - i.e., the staff projecting their own beliefs on why Card went from talking about breaking Sherman Adams' record as Eisenhower's CoS, one week, to a quickly-arranged departure the next - are telling him. But if Mr. Woodward were to start digging into that story, I bet his journalistic instincts would tell him that there is much more to it than "Andy Card was a hardass."

... as the Great American Cockroach Check is now in full swing.

As DUers have spread the word, more and more people are checking their pension plan documents, and many are discovering that they have a State Street and/or CitiStreet infestation (CitiStreet is the 50/50 joint venture between State Street and CitiStreet, and does a lot of the customer service rep stuff for plan participants).

For some reason, many Americans just don't seem to want the company that Elaine Chao and Eugene Scalia handpicked to hush up the *Enron* pension scandal, having anything to do with *their* pension fund. For some reason, these Americans really don't want the company whose CEO - Ron Logue, the Rogue - touts his ties to Andy Card and Ron Kaufman, having anything to do with *their* pension fund.

Local union memberships are now asking their leaders to hire lawyers to look into State Street's pension plan practices - and the media is beginning to take notice.

Last night, I spent several hours on deep background with a gentleman whose media organization has a global reach. We'll see what comes of that.

So, celebrate today for what it is: the nominal anniversary of the over-reach of a corrupt cabal of yore, whose heirs still operate to suppress knowledge today.

Remember that on what was then known as Friday, October 13, 1307 (just any other day back then) - on the secret orders of a corrupt King and a corrupt Pope - the Knights Templar in France were rounded up and charged with all manner of false charges, imprisoned indefinitely, tortured for false confessions, and then executed without fair trials. State Street tried to really gut Northern Trust of Chicago on the Enron deal. All you have to do is read this opinion of The Honorable William H. Pauley, III of the Southern District of New York to figure out that:

1. When Elaine Chao and Eugene Scalia handpicked State Street to replace Northern Trust, State Street tried to use the appointment as "special fiduciary" as a vehicle to do permanent damage to its Chicago-based rival. How?

2. By sharing with the Enron retirees' attorneys certain "industry-wide practices" in the pension industry, which State Street urged those attorneys to look into with respect to its rival's conduct while serving as the Enron trustee, prior to its removal by the Labor Department. But that tactic backfired when:

3. That same law firm, Keller Rohrback, took the Polaroiders' case against - delicious irony - State Street.

4. State Street tried to get Keller Rohrback thrown off the Polaroid case, on the grounds that it never imagined that the "industry practices tutorial" State Street gave Keller Rohrback to go after Northern Trust would ever boomerang:

There are magnificent - TRULY magnificent - career prosecutors and FBI agents working throughout America.

While it is very true that certain jurisdictions (SDNY, e.g.) see a disproportionate share of the headlines, there are career prosecutors who have built solid careers on public corruption cases.

Given the players involved, and the hub and spoke nature (with the EOP being the hub, and State Street and Halliburton being two of the spokes), it probably makes more sense for one of the Beltway jurisdictions to take the lead on this multi-jurisdictional matter.

Your style of writing in these threads and the style of oldleftielawyer are so similar, I immediately figured you were one and the same. I have always enjoyed reading OLL's posts, so this is a compliment. However, OLL seemed to poo-poo any talk of PlameGate ever coming to fruition. This teasing of a Big Deal seems similar but opposite, giving hope to those of us who want a Big Deal to bring down the administration.

I have looked forward to this month's Ides with hope in my heart. My concern is that this controversy is too complicated for the Average Joe to comprehend. I mean, even an outed beautiful female spy didn't grab their attention.

I hope the sound bites for this scandal are simple and grabby. Pedophiles the general public understands in its heart. Convoluted banking and pension scandals do not reach into the public's mind. It's gotta grab. I want it to deliver. Please.

As for sound-bity: months have been spent distilling the message down. The DU demographic can handle the nuances and the detail, though - and so can the American public at large, once the primer / catchphrase version has grabbed their attention.

116. Two main strands...
1. Halliburton: tons of new internal documents show how the company coordinated with the Vice President's Office and the EOP, to try to quell the investigation into Foreign Corrupt Practices Act violations and tax evasion on a massive scale. This strand takes the public corruption investigations into the heart of the White House.

2. State Street: the Andy Card / Ron Kaufman / Ron Logue connection becomes the missing puzzle piece in explaining "Why" Enron's pension fund was switched over to State Street by Elaine Chao and Eugene Scalia. This strand causes Americans to check their pension plans, to see if they're infested by State Street, the Bushiest Bank of All.

As you have no doubt seen, there are many sub-strands off those two main threads, but that should be a clean enough synopsis.

Of all the sub-threads you've skimmed, which are most interesting to you personally?

Is there anything short of a major breaking story on Halliburton or State Street that should tip us off, any other resignations or so on -- or is this just going to kind of explode all at once?

Also, the Masonic angle is tantalizing -- any more insights along those lines?

... after all, any American smart enough to be saving for retirement is smart enough to do the simple check of his/her plan documents to see whether or not their plan is infected by the Bushiest Bank of All.

Once a person has a reason to care, it's amazing to see how quickly they move from basic understanding to a deeper understanding.

Having an electorate that is engaged - motivated by enlightened self-interest (here, the safety of their pensions) - is a great tonic for what ails Congress (the branch that is supposed to be nearest to The People).

For the Executive Branch, I think it is going to be the demise of the latest Imperial Presidency, and a real boon to career civil servants (e.g., career prosecutors) who forego large private sector salaries to make the government function.

For the Judicial Branch - with any luck - it's going to remind Americans that "activist" judges are a good thing, if they're "actively" defending the Constitution.

For public policy debates such as Social Security privatization and military/defense contracting, it's going to force corporate interests to 'fess up about their practices.

And, with a lot of luck, it's going to make Americans realize that there are still good, solid, honest, patriotic Americans out there, who will blow the whistle when they see powerful wrongdoers flouting the law.

State Street was even singled out for its "pay to play" tactics by a top SEC official during the Clinton years. "Pay to play," or "pay for play" is a practice whereby an unscrupulous company "pays" bundled campaign contributions in order to be able to "play" on bidding for contracts.

The practice would probably just have been called by what it was commonly known when the Founders wrote the Constitution: Bribery. When people's pensions are concerned, fiduciary duties are supposed to trump graft.
