50. I believe it's more important to IMPRESS upon him that,...
,...Alito WILL expand executive powers. He testified that he believes the theory of a "unitary executive" would be appropriate 'in certain circumstances'. RED FLAG!!!

The RW neoconsters are placing the pieces to destroy our form of government. The Honorable Robert Byrd needs to know that.

Don't be demeaning to this incredible man. Be sincere and, for crying out loud, be rational.

22. I concur, radio--
Byrd's a very aged self-styled 'gentleman of the old Southern School'. Polite but firm language will likely have more effect.

That being said, I myself e-mailed that if he carried through with his stated intention of voting for Alito, I would "support any move by his WV electorate to run him out of the state on a rail in tar & feathers", and I quote.

Something came up about a firewall and 'denied'. I'll post it here and I saved it so maybe I can send it later.

To Sen. Byrd:
I do not understand your support for Judge Alito. This man is part of a larger issue of skewing the Supreme Court in favor of big business and complete presidential power and away from the rights of every day citizens. I hope you will not end up regretting your decision as we watch the Constitution being trampled by the extremists currently in power. We have already seen the results of Mr. Bush's nominees' evasiveness and deception. Justice Roberts has already voted against what he claimed to believe in his confirmation hearings re: the right to die decision of the state of Oregon. Judge Alito has been even more evasive and deceptive. I do not trust a Supreme Court loaded with Scalias, Alitos and Roberts to uphold the Constitution. I believe they will NOT act in an independent manner and will always defer to the Republican Party and it's extremist base in it's decisions. Please reconsider your decision.

Respectfully Yours

Senators like to say that they don't have a litmus test for judges but I have a litmus tests for them and this is fucking it. I want to see them fight tooth and nail, even if it is a losing battle. If Byrd doesn't do something soon to redeem himself, I've lost all respect for him. This vote is a levels the playing field. A yes is a yes, no matter if it comes from a D or a R. With all his speeches and Constitution-waving, in this case, Byrd is no different from Frist.

51. In September 2002
Kef created the "Byrd Watch" threads. These threads went on for six weeks.

Senator Byrd stood, alone, on the floor of the Senate, w/his copy of our Constitution in hand, eloquently demanding all congress people to vote NO on the IWR.

For those who were not at DU at the time, we sent him hundreds of dollars worth of flowers in appreciate for his incredible effort. He thanked us on the Senate floor and called us his heros.

In my email to him, I reminded him of this and the importance of our Constitution to him.

Damn, this depresses the hell out of me.

Dear Senator Byrd,

As a longtime supporter of yours, I for one was astonished to learn that you plan to vote for the confirmation of Judge Alito. I do not think he is the "man" for the job.

We need to have a fair and balanced Supreme Court, not a Supreme Court staffed with a bunch of old cronies! We need a person in this vital job that has respect for all citizens and the laws of our country.

Why do you support him? I do not appreciate knowing that you support a man that at least in his mind supports overturning Roe v. Wade, and yes, sadly, that is what this entire thing is about, a woman's right to choose.

I for one as a woman most certainly support a woman's right to choose. If I support women's rights, I should certainly hope that Alito does but no one was ever able to really get Alito to say one way or the other behind his smokescreen what he believes about the law Roe v. Wade.

All I can say to you is that it is too bad that you are not a woman and that you have never had to walk in the shoes of the most discriminated against group of human beings in our country - that group being women.

I resent the fact greatly that men are the ones making decisions about what is personal to a female. It is no man nor woman's business what an individual of the female sex might care to do to her body and that includes kill it should she so desire.

Perhaps that might sound a bit extreme to you, but it is my understanding that Alito doesn't have any respect for the disabled in our society, another group of persons that are constantly being discriminated against in one way or another by our "compansionate" society in which we now live in. Where is this compassion I ask you? Where?

I ask you to rethink your plan to support Alito. I for one certainly do not support him nor one tiny piece of what his real agenda might be. What is his real agenda? Does anyone have the answer to this?

Sincerely,

54. I wrote:
As a Democratic Tennessean with virtually no representation in the Senate for my beliefs and opinions, I am appealing to you as a fellow Southerner to support John Kerry's filibuster of Samuel Alito.

Alito's court position would not only threaten my rights as a woman to chose, but would expand executive powers so that our rights as Americans, afforded to us by the Constitution, would be nearly null.

The processes of the checks and balances our founding fathers put forth in creating this great country are being violated while George W. Bush and his administration spy on us with no judicial oversight.

I realize we're at war and protection of our country is important, but, honestly, if we are to shread our beautiful Constitution, what is there left to protect?

Please reconsider and stand with Kerry. Please. I don't want my son growing up in a country that is becoming the equivilant of a facist regime.

59. note sent. Here's part of my letter...
Senator Byrd,

I'm not a constituent, but I'm a life-long democrat who's fought all my life to support the little guy from over-reaching government and corporations. My father and grandfather were coal miners who died from lung disease. I watched the hearings last week about coal mine safety, and I was moved to tears by your statements about the need to protect our miners from corporations who always put profits above worker safety.

I was shocked to hear this evening that you intend to support the nomination of Judge Alito to the Supreme Court. Judge Alito's record shows he consistently sides with the Corporations and Government against the common American citizen.

PLEASE RECONSIDER! The little people in this country need your support. Please vote against Judge Alito.

64. Thank you, BBJ. My letter to Senator Byrd:
Your web site headline reads "Leadership. Character. Commitment." I want to tell you that of all the Senators, the one who has always reminded me most of Jimmy Stewart in Mr. Smith Goes To Washington is you, Senator Byrd.

Filibuster, Senator. This is not the time to gamble with the future. Alito may have judicial credentials the length of your arm, but his ethical judgment is sorely lacking. For Vanguard alone he is eminently unqualified to sit on the highest bench of this land.

Your legacy is at stake. All the work you've done through the years, wasted, if you vote for Alito or fail to support a filibuster. This is all you will be remembered for, that in one moment which could define the courage of Democrats, you failed us.

65. My 'letter' ...
Your support for the appointment of Sam Alito to this nation's Supreme Court is the single most disappointing decision you've made since you opposed federal civil rights legislation!

Sam Alito is a tool of the extreme, plutocratic right wing of this country, a right wing that's embracing ideologies virtually indistinguishable from the fascism of Franco and Henry Ford. He's a proven liar and hypocrite. He's no more an "originalist" or "strict constructionist" than Scalia or Thomas, the latter being the most appalling addition to the highest court in the nation since its founding. These are autocrats who see only entitlements for privilege and power in the Constitution, do not see the bounds of government authority and see all kinds of imaginary avenues for abridgment of human rights and civil liberties. Their views are a complete repudiation of original intent ... seeing private liberties only in government-licensed corporations and not individuals.

Please! Reconsider!

70. Done. Thank you. I can't believe Byrd is doing this!
Edited on Fri Jan-27-06 02:34 AM by PVK
Remember his stance earlier this year with MoveOn? He was urging everyone to FIGHT to stop the stacking of the courts!

What in the world is going on?

71. Here's my 2 cents worth
NO ON ALITO - FILIBUSTER ALITO.
Please remember that constitution you carry in your pocket and protect our form of government. Doesn't the "unitary executive" view of the Presidency that Alito espouses go against EVERYTHING our representative form of government stands for?? Come on Senator Byrd- be brave- block this nomination. Thank you.

73. My letter to the good Senator
Senator Byrd:

Although I am not your constituent, I have long admired your viewpoints. Your knowledge of the Constitution of the United States is second to none in the Senate, and your defense of it has been most eloquent in an age of inelegant discourse.

As such, I hope you can understand my bewilderment of your supporting Sam Alito to the highest court in the land. Judge Alito's support of the Unitary Executive theory represents the greatest threat to the Republic in modern times. In short, the White House and Judge Alito believe the Constitution implies the Executive branch can act at will during times of war, even to the point of violating other Constitutional rights. Senator Byrd, call the Unitary Executive theory what it is: Bush is trying to justify unchecked dictatorial powers with no sunset provision during a phony war. Do you not see that our Republic now teeters on the edge of dictatorship? Do you want to be responsible for enabling George W. Bush to shatter the rule of law?

I urge you to reverse your support for Judge Alito. Your reconsideration may make matters difficult with re-election, but if there is anyone who can explain why you withdrew your support from Judge Alito and his threat to our country and Constitution, it surely is you. What good is re-election if you no longer recognize the country you live in once Judge Alito is on the Supreme Court and George W. Bush is above the law?

Stand for the United States. Stand for the Constitution. But above all, Senator Byrd, stand for We, the People who live in this great land and abide by its laws.

Sincerely,
XXX

74. Sent (within)
Senator Byrd,

I am highly disturbed by your decision to vote for that RW idealog - Samuel Alito to the Supreme Court. If there was ever a time in one's life to take a stand, this is it. This man is a small-minded civet and he will form a band of three non-thinking RW idealogs who will vote as a block for ALL RW concerns (Scalia, Thomas, Alito). This is unacceptable that we already have 2 RW idealogs in there, but three mindless angry bigots?

76. Byrd has 1000% the integrity of Kerry
this speech

http://byrd.senate.gov/speeches/2006_january/alito.html

Senator Byrd made me sit back and think, he made this speech from the seat of the Senate floor, not from overseas just in time for the evening news. Byrd meant every word he said. He stated concisely the issues that mattered to him, and he articulated his true beliefs. Byrd is an old man, you think he really gives a shit what people thinks?! you reach a point in your life when you can easily say what you feel, not what you think others want to hear. He had the balls to say what he truly felt and believed. The Senator lovingly and eloquently expressed the very fundamental foundations of the constitution that are clearly dear to him, as well as the rest of us.

Do I want to believe Kerry is doing this because he thinks its right or does he smell a political advantage in pushing for a filibuster when in all likelihood he is well aware the votes are just not there.

Byrd does not deserve flack for taking a very justified and principled stand.

78. Integrity? Byrd voted YES for the BANKRUPTCY BILL
If THAT is what you call integrity, you can have it.

It took integrity and GUTS to earn those medals in Vietnam.
Even today, Kerry is risking his political career by sticking his
neck out by being the first to say he will fillibuster.

No one is telling anyone to give flack to Sen. Byrd, but rather
to send an email suggesting in no uncertain way that he should
change his vote.

82. Yes and no
Yes, I agree that Byrd really believes that he is doing the right thing, I do not agree with his stand, nor do I understand it, but I do not think he should be branded a "sell out".

No, I do not agree that Kerry's position is just posturing, far from it. What he did is risky and can easily backfire. The fact that he was away when the announcement was first made may open the door for unfortunate sophomoric remarks, but has no significance whatsoever. I am sure the trip was planned long in advance + he waited hoping that the leadership will take a position on this, the way it should have been.
