The 110th Congress won't have the Gang of 14's deal anymore. Remember?
The Nuclear Option will be back on the table. Will the repukes continue to threaten the Nuclear Option if the Senate is 50/50? With INSANEtorum and Frist gone, will the repukes forget about the Nuclear Option? Will their cocky, arrogant attitudes be gone because the people of this country handed them their asses on a platter? Whaddaya think? How is the Nuclear Option going to play in the 110th Congress? Will it even be a factor? It would only come into play over a SC Justice confirmation, right? What if the psycho gets another chance to nominate a justice and the Dems threaten a filibuster? How will this all play out with a NEW senate? Any thoughts?

1. If we get the majority it'll all be a moot point
Because none of the gang of 14 are on the Judiciary Committee and Patrick Leahy runs a pretty tight ship with that committee. When we had the majority back in 2002, they did a great job keeping about 10 nominees from every making it to the floor vote.

It's nice to not have to do all that work for a filibuster when all we need to do is convince 10-11 senators to stick together.
