5. Durin, Stabenow and Sarbanes would support a filly
But on the Senate floor late Thursday, Kennedy said support is growing for a filibuster, and Durbin, along with Sens. Debbie Stabenow of Michigan and Paul Sarbanes of Maryland would back an attempt.

Republicans, however, have already said they'll have the 60 votes needed in the Senate to break a filibuster and end the debate, so such a threat probably won't have an impact.

That's what I'm thinking. It's been said Reid has been working on the fillibuster, and the DLC opposes it. So why couldn't a Democratic leadership aide be a Democratic Leadership Council aide?

If they feel they will not lose votes or the base by refusing to filibuster, there's no compelling reason to filibuster.

It's the tie that binds. Republicans are behind Alito and against a filibuster because the religiously insane base will walk if they don't.

There is no tie that binds that way for the Democratic base, thus no compelling reason to filibuster.

The only way they will filibuster is if they feel the heat.
