North Dakota Democrats expected to ensure Alito's confirmation

As Sen. John Kerry (D-MA) mounts a longshot bid to filibuster Bush Supreme Court nominee Samuel Alito, more indications suggest that Democrats will back the nominee to the Supreme Court, despite widespread disaffection in the Democratic caucus.

The Wall Street Journal's Washington Wire, along with today's Washington Post, signaled that Sen. Kent Conrad (D-ND) and Sen. Byron Dorgan (D-ND) are unlikely to support a filibuster, and may vote to support Alito.

RAW STORY's own surveys of Democratic senators, along with sources on the Judiciary Committee and Senate Democratic leadership, indicate Alito will be confirmed. While only three Democrats have formally announced their support for Alito, Democrats need only lose five senators to render a filibuster impossible.

Indications suggest that several senators that could vote against Alito -- including Sen. Mary Landrieu (D-LA) and Sen. Ben Nelson (D-FL) -- are unlikely to support a filibuster.

I think they won't filibuster Alito, because they want to keep the filibuster for when Justice Stevens or Justice Ginsburg either retire or pass away.

Whilst Alito is not a good choice and has dangerous views, Alito will not be the fifth vote.

The next Supreme Court choice of Junior's will be the fifth vote...and THAT'S when the filibuster will be on and it'll be the filibuster of filibuster's, it'll be nasty and bloody.

6. You are not exactly correct on this.
First, Alito will be replacing a conservative swing vote with a very extreme conservative one. The court leans right with Alito. They do not have to wait for another appointment.

7. I was thinking of Justice Kennedy
Justice Kennedy might now be the swing vote, he's not hardcore Right-Wing like Scalia, Thomas, Roberts and Alito.

I'm also attempting to think outside the box, so to speak, and attempting to think of the logic as to why we're not doing a filibuster of Alito.

8. You may be onto something there...
At least I hope you are. But you would think that someone who is somewhat moderate wouldn't want the court to swing too far in one direction or the other. Therefore, Kennedy might move a little to the left to accomodate for O'Connor. Or maybe not. One can hope, though.

13. Justice Kennedy doesn't have such a Far Right judicial record, so yes
I would hope that he see's that he has to be the voice of reason amongst the Conservative side.

12. You are very perceptive and logical....
I concurr that two more vacancies could happen during
shrub's rule, and if they filibuster Alito then it will
be harder to successfully filibuster justice Ginsburg
replacement who is not in the best of health.

That would be THE nightmare scenario, two more vacancies for Junior. I know that this nutjob Edith Hollan Jones would be on the shortlist, she's frightening, read all about her here:

Whilst I totally disagree with everything that Samuel Alito stands for, I'm not sure that a filibuster of him is a sensible thing to do. What people have to realize, is that there are worse Judges than Alito, and I think we need to keep the filibuster for if Justice Stevens and Justice Ginsburg cause a vacancy.

We need to keep our heavy artillery for that mega fight.

because they are chickenshits. If they won't stand up for the Constitution - they won't stand up for anything.

It makes no difference whether there is an R or a D behind most of their names. Disgusting. This colossal wimp-out on the Dems part will have a huge depressing impact on votes for Dems in this year's midterms. Despite the Repukes abuse of power, the corruption, the torture, the invasion of privacy, the criminality etal - the Repukes played them like the fools they are, and as a result will likely gain even more seats in both houses, due to the Dems crumbling into appeasement, yet again, when the chips were down.

The weenies have demonstrated that it is a waste of time and money for people to work for the election of Democrats. It's all a charade. If they are going to vote like Repukes, what the hell is the sense of working our asses off for them to turn around and say fuck you - I'm voting with the neo-fascists?

I am with mopaul. To start getting our country back, I think it would take a massive number of us going right into DC and dragging them out by their heels (weenie Dems included), putting them under citizens' arrest for fraud, corruption and treason and trying them in a peoples' court. Our government has become our enemy. Many have warned about this for two centuries. Thanks to the despicable, weenie Dems - who allowed it to happen.

20. I like tea, I especially like Assam and Darjeeling, neither from Boston
Assam is grown mainly in the Brahmaputra valley in India. Assam is a deep-amber colored tea, it's slightly strong but incredibly refreshing.

Darjeeling is grown in the Darjeeling region of India. It was known during the day of the Raj, as the Sultan's tea. Darjeeling is a black tea, it's flavor is light and spirited.

Oh yes, Boston...the Red Sox are good, but I support the Card's, so.

and why I have not been more optimistic about the efforts of Kerry, et, al.
