Dayton to vote against Alito

WASHINGTON - Sen. Mark Dayton said Friday he will vote against the Supreme Court nomination of Samuel Alito, but that he hadn't decided on whether to support a filibuster.

Dayton, D-Minn., said he questioned the wisdom of a filibuster when it's clear that Democrats don't have the votes to maintain the delaying tactic.

Without the necessary 41 votes, Dayton said on a conference call with reporters, a filibuster would be an "exercise in futility." He added he would support a filibuster if it had a chance of succeeding.

Democrats and Republicans both said that Alito will get more than the 60 votes need to cut off debate on the Senate floor Monday.
