Did not find against the 4th amendment. Must be probable cause that he is a danger. JA disagreed, he believes the shooting is legal. State is allowed to use any force necisary(SP) to uphold law.

Samuel Alito is credited with this; he suggested it when he worked for Ronald Reagan. Senator Dayton said in his speech that Bush had added over 100 presidential signing statements to bills since he took office!

They will continue to do so until they get 41 senators to support the filibuster, or until John Kerry begins it on Monday. They are airing on their regular show today, from 3-6 PST on Sirius Satellite Radio, channel 146, and then on their web stream for the rest of the weekend.
