DEMOCRATS WILL REVISIT MILITARY HABEAS DEBATE
Likely Chair Leahy Objects to Limits on Detainees' Rights


Sen. Patrick Leahy's first efforts as probable Chair of the Senate Judiciary Committee will be to
hold hearings to restore some of the habeas rights taken away by the Military Commissions bill.

Sen. Patrick Leahy of Vermont, who is expected to become chairman, confirmed Thursday that he is drafting a bill to undo portions of a recently passed law that prevent terrorism detainees from going to federal court to challenge the government's right to hold them indefinitely.

Leahy's goal is to "try and do something to reverse the damage," said his spokeswoman, Tracy Schmaler.

I am turning my World Wide Web page black for 48 hours as part of the protest by my fellow Internet users against the online censorship provisions of the new telecommunications law. The online censorship provisions should be repealed, and I plan to introduce legislation to do just that.

I was one of five Senators who voted against this legislation, in large part because of what I believe are unconstitutional restrictions on what we can say online. While I do not condone the transmission of obscene material or child pornography on the Net, I believe the solution proposed in the telecommunications law will do more to harm the use and growth of the Net without combatting the problem for which it is intended.

20. GREAT NEWS! Except "some" is a problem word, there is NEVER
a need for the government (as it must with habeas) to show that it is legally holding people SOME of the time. ALL OF THE TIME, or else it's either not a right we own, or else it is not a human right (one owned by all) and is only a right owned by some.

The citizen noncitizen distinction is misleading in several major respects not the least of which is that we are supposed to have a government of limited powers, not unlimited powers. The rights come from an endowment by our creator, as jefferson put it. The creator doesn't care that much about citizenship questions. Even more importantly, the sugguest that a noncitizen exception makes any kind of moral, ethical, or human rights sense is nearly as offensive as hitler arguing to germans that they need not worry the camps are not intended for good german citizens....

44. You're correct. Many legal residents of the US are treated
horribly right now as I type. Many are gathered up and either held indefinitely or are being returned to their "country of origin" though they are not a danger nor have been since they've been here.

Leahy's statement from the floor of the Senate on Sept. 28:
It grieves me to think that three decades in this body that I stand here in the Senate, knowing that we’re thinking of doing this. It is so wrong. It is unconstitutional. It is un-American. It is designed to ensure the Bush-Cheney administration will never again be embarrassed by a United States Supreme Court decision reviewing its unlawful abuses of power. The Supreme Court said, ‘You abused your power.’ He said, ‘Ha, we’ll fix that. We have a rubber stamp, a rubber stamp, Congress, that will just set that aside and give us power that nobody, no king or anybody else set foot in this land, ever thought of having.’


On the Sept. 29th Democracy Now! program, Amy Goodman played the comments of Sen. Jeff Sessions (R-AL) and asked Leahy to comment.
SEN. JEFF SESSIONS: It was never, ever, ever, ever intended or imagined that during the War of 1812, that it British soldiers were captured burning of the Capitol of the United States, as they did, that they would have been given habeas corpus rights. It was never thought to be. habeas corpus was applied to citizens, really, at that time, and I believe that that’s so plain as to be without dispute.

SEN. PATRICK LEAHY: Well, I wish it was as plain as he says. Of course, in the Hamdan decision, the U.S. Supreme Court has made it very clear that it is available in somebody captured. In a case like what he was talking about, if somebody had been captured there and held in prison, and they said, “You have the wrong person,” they could at least raise it. And you also have, of course, under the Constitution, that habeas can be suspended if there is an invasion, if there is an insurrection. We have neither case here. Even the most conservative Republican legal thinkers have said this is not a case to suspend habeas corpus.

You know, they can set up all the straw men they want, but the fact is this allows the Bush administration to act totally arbitrarily with no court or anybody else to raise any questions about it. It allows them to cover up any mistakes they make. And this goes beyond just marking everything “secret,” as they do now. Every mistake they make, they just mark it “secret.” But this is even worse. This means somebody could be locked up for five years, ten years, fifteen years, twenty years. They have the wrong person, and they have no rights to be able to say, “Hey guys, you’ve got the wrong person.” It goes against everything that we’ve done as Americans.

You know, when things like this were done during the Cold War in some of the Iron Curtain countries, I remember all the speeches on the Senate floor, Democrats and Republicans alike saying, “How horrible this is! Thank God we don’t do things like this in America.” I wish they’d go back and listen to some of their speeches at that time.

A very worthwhile research project would be to find speeches by American Senators and Congressional reps condemning other countries' lack of habeas corpus protection.

137. fantastic, this is a priority, the first thing to do
without a doubt the worst of the bushits attacks on the constitution. the little decider should be in prison for violating his oath of office to uphole and defend the constitution. he should be in prison for many things but this one is way beyond the pale. doing away with habeus was the worst assault against the people of this country.
