1. I'm sure Bayh won't vote for confirmation. He didn't vote for
Roberts (who was from Indiana!). Whether he'll filibuster depends on how all the other Dems go. Bayh is ambitious and cautious.

2. Uh...count of what?
Is this a count of people voting yes? voting no? voting yes on Alito? or on Fillibuster? Or just a list of really snazzy people? Some more information would be helpful.

Being from NJ I'd find it hard to believe that Lautenberg and especially new guy Menendez would vote for Alito or for cloture.

4. This is who is left to vote yes or no.
34 Dems are no votes. 8 Dems left. They all vote no that is 42 no votes. Correct me if I'm am wrong.

9. No, it doesn't show that, but I think that there is some information
out there that Cspan does not show on its screen.

8. All the NJ Senators' offices say is that they will speak
on the Senate floor around 2:00 or so.

I also called Bayh's office - I lived in Indiana until I graduated from IU (didn't say that was 1972), then left because of a job opportunity. The staffer was nice but gave no hint of where he would come out on this issue.
