Do we have an updated head count? Ensign not present, Pryor abstaining, Dayton ???. Where are we?

2. C-SPAN's tally = 37 Dem NO votes 57 repuke yes votes.
and I have no clue who's left to give a speech. Bayh is one I know of.

3. Pryor and Harkin are both abstaining
last I heard Dayton was going to support the filibuster. I don't think Menendez and Lautenberg explicitly made statements about the cloture vote but their floor speeches were such strong no's for confirmation that they will probably support the filibuster.

but once Kerry said he was going to do it, the worst possible thing he could do would be to back down. Even if it flops, it's given the R's a scare to see the "powerless" Dems actually try to defy them.

11. it's not winning; it's a by to the next round
and unless someone deliberately caused his accident, I don't think we need to feel bad about it. I'm glad his injuries aren't serious; even minor car accidents are pretty scary.

I can't say for sure about filibuster. They need 6 Democrats don't they?

I'm assuming they have the 4 Democrats who are going to vote for confirmation, and word is that Lieberman is now going to vote for cloture. So it's tight as can be.
