Can a state strip a child of his citizenship rights?

Can a state strip a child of his citizenship rights?
Why I ask is State Rep. Leo Berman (R) here in Texas proposed legislation that in effect does just that.

It will make it illegal for children of illegal immigrants, even if the child is born in the US, (which would make them a US citizen) to receive any benefits. This includes WIC, Medicaid, etc. But also they cannot even attend public schools!

I'm OUTRAGED!

1. If the child is born in the US, the child is a citizen.
There is no way around that.

That is one way around jus soli. Also children born to enemy forces in a hostile occupation of US territory.

I just cannot believe that they would go after the children of illegal immigrants and not the business that employ them!

4. Since those rights are emunerated by the *US* Constitution, I doubt it.
Which is to say it would be ILLEGAL... which
is certainly _NOT_ the same as saying that someone
with an (R) after their name wouldn't do it if they
thought they could get away with it.

6. It comes down to what are "citizenship rights," and...
...things like Medicaid, etc., occupy a questionable zone for that. They can certainly require that applicants for benefits meet certain qualifications, and deny benefits to those who do not meet those qualifications. That's Constitutional.

I'm not sure, however, if having parents who are citizens would stand up as an appropriate qualification if challenged.

Hopefully it won't get that far.

18. Before it can be struck down, it will likely be enforced.
My home town redefined "family" last year to oust Hispanics with aunts, uncles, or cousins in the house. The law was enforced by complaint only. Several of the families who were turned in had no criminal records, made no mess, and bothered no one. The law only stood for a couple of weeks, but the Hispanic families forced out of town by it didn't come back.
