Burner (D) 49%, Reichert (R) 51%, 75% of precincts reporting
This is Washington's 8th District. Burner has conceded the race! Why? One quarter of the votes are left to be counted and 2% seperates them!

Burner congratulated the former King County sheriff in a Monday night phone call, but she refused to publicly concede the race until a Tuesday morning news conference.

20,000 Absentee ballots from people who where decided to drop their ballots off at the polling place....King County is still deciding if they will count them...

6. It probably depends on where the votes that haven't been counted are coming in from
If they're from staunchly republikkan areas and their pollng shows the votes went against her, that's why she's conceding.
They'll count all the votes.
In the event it shows her the winner, then she'll get the seat.

9. they aren't. They are in King Co (Seattle) which is quite blue.

Based on an estimate I read in the PI. One of those votes is mine. I called KingCo this a.m. and the person who answered assured me that all the votes would be counted, but the Canvassing Board is meeting at 1:30 today to discuss the "recommendation" that all the votes be counted.

So maybe Bush v. Gore didn't establish a legal precedent, but it certainly seems to have led to the situation where counting ALL the votes is considered optional.
