Two things we can do to preserve Roe vs. Wade in the future |
|
However, one of them will require that we control Congress:
1. Expand the Supreme Court to 11 justices. This has been done several times throughout history, unfortunately its most recent attempt failed when FDR tried to do it on the grounds of replacing older justices. We will need control of the Senate (or perhaps both Houses, but since the Senate watches over the Supreme Court it is probably the only branch we need.) Expanding the Supreme Court could turn 5-4 decisions against the right to choose, into 6-5 decisions to preserve the right to choose.
2. Create a Right to Privacy Amendment. We don't have to specifically stay the right to an abortion, because I don't think that the amendment would pass Congress or be ratified by enough states, but we can imply it's right, in a way that makes the right to choose even more clearly stated than it is now under the 4th Amendment.

1. I started thinking about the amendment yesterday. |

For some reason, and I could be wrong, I think that would be easier than the SCOTUS option. I just think that from here on out, the Republicans will be so protective of the court, we won't get to change anything until another justice leaves and we control the Senate.
