Jennings spokesman David Kochman told CQPolitics.com Friday that ES&S was named in the lawsuit in hope of spurring a more thorough investigation. Kochman said the source codes on the machines, which are currently exempt from public record, may contain valuable information about the voting machine’s history.
Kochman said the Jennings campaign has heard hundreds of reports from voters who said they tried to cast a ballot for Jennings but found their vote had not registered when the machine displayed a review screen. “We’re very confident that there was a machine failure,” said Kochman.
Kochman was adamant that nothing revealed in the audit could prompt a concession, saying, “Absolutely not. ... Until there is a thorough investigation by outside experts to find out what went wrong, we’re not going to give up.”
Kochman added, “The report that’s coming out in a couple weeks is recommending to not use this type of equipment anymore.” He was referring to pending recommendations by the federal government’s National Institute of Standards and Technology (NIST), reported in Friday’s edition of the Washington Post, that call for elections officials to reject voting systems that rely on electronic software to recount votes rather than paper receipts.
