Can Reuters be sued for publishing this photo?

11. Hypothetical question: Could a person argue that their ass is
so distinctive in its dimensions that large numbers of people could be expected to recognize the person by such a photo alone?

I'm just wondering what Rush will do for his pill money if his ratings continue to drop.:P

What is it about the photo that could possibly be actionable? There is nothing inaccurate about the photo or the related caption and the person in the photo can't be identified.

5. This would constitute fair use
since the person cannot be identified. Also I think this would fall under editorial use, which would qualify it as fair use in most jurisdictions even if the face were visible.

the person is in a public place, the photo-journalist has every right to take their photo.

Although, if she was in a public place, they can photograph what they like. With her face in the pic, they would ask for permission..
