DUers understand: ...this is the way they're going to try to justify taking over. They'll say Big effing deal...a vote or two...but you need 60 to govern.

That's utter BS...they governed 'great' with 55 and fewer...these bastards have more tricks than you have hair on your head.

But hey, if they really want to thwart the democratic (small d) will of the People (large P), and they're allowed to do so via some weasely legal technicality and sheer lack of shame, not that we can stop them, but let them - the stench will follow them all the way into 2008, when the potential Senate pickups for the Democratic Party are far more favorable than the squeaker, improbable victory this past November.

5. He doesn't have to show up
If Mr. Johnson is still in hospital or otherwise unable to vote but alive the Democratic party will hold a majority in the Senate of 50 - 49. According to the Congressional historian he has to resign or die for the SD repuke Governor to appoint a replacement.

That being said however, I would love to see him walk into the Senate on opening day.
