Tiller charges dismissed

TOPEKA (AP) -- A Sedgwick County judge dismissed 30 misdemeanor criminal charges against Wichita physician and abortion provider George Tiller, less than a day after recently defeated Attorney General Phill Kline filed them.

Kline said he would still attempt Friday to get the judge to reconsider and reinstate the charges, which involve 15 abortions from July through November 2003, on patients aged 10 to 22. But there was no word that he'd succeeded when the Sedgwick County Courthouse closed for the weekend and Christmas holiday.

Kline alleged in his complaint that Tiller had improperly performed late-term abortions and hadn't properly reported information to the state Department of Health and Environment. Tiller's attorneys said he hasn't broken any laws.

''We are pursuing a legal remedy to what we consider a flawed decision by a district court judge,'' Kline said during a news conference in Topeka.

Judge Paul W. Clark dismissed the case against Tiller after Sedgwick County District Attorney Nola Foulston said that her office had not been consulted by Kline, a vocal opponent of abortion.

5. He's not going away either
Kline has been elected to replace Morrison as DA in Johnson County (Kansas City, KS) because Morrison was elected to be, you guessed it, the AG replacing Kline. http://www.democraticunderground.com/discuss/duboard.php?az=show_mesg&forum=153&topic_id=6559&mesg_id=6559

3. This prosecutor wants to break medical confidentiality too
so that he can go after whoever the father of that child was.

Have an abortion, hand over the father for serious prison time without your consent being required.

Of course that might lead to certain unwanted consequences.

Kline is a RW zealot who was soundly defeated last month. Unfortunately, Kline already has a new job, thanks to the Johnson County GOP. JoCo just lost its DA, Paul Morrison, in the last election. Morrison was elected to replace Kline as AG. Morrison is one of the Kansas Republicans who had enough of their own party and joined the Democratic Party. Morrison won his spot as the JoCo DA as Republican but won his term as AG as a Democrat. Anyway, because Morrison was elected DA as a Republican, the JoCo GOP got to vote for his replacement to fill out the last two years of Morrison's term, and they picked, Phill Kline. :eyes: Morrison got 65% of the vote for AG in JoCo and Kline only got 35%. Since Kline's selection there have been several high profile departures from the Kansas GOP and at least one Asst. DA has resigned rather than work for Kline. There is already talk of recalling Kline, who won't be sworn in until next month.

anyway. But that is a good death not a bad one. Lets lock them all up.

7. First and foremost, Kline is anti-abortion
He wants to shut down abortion providers in Kansas, period. He is using these cases as the excuse to close them down. The fact that a 10 year old had an abortion is secondary to him. Kline's first targets are the clinics. He doesn't care whose life he disrupts or who he hurts, he just wants to shut down anyone who provides abortion services.

I went to school with a couple of those Operation Rescue people. They're the ones who demonstrate outside women's clinics and yell "baby killers" to all the women going in. They don't care how a female got pregnant or if the pregnancy needs to be terminated, they just want it born. Kline thinks along the same lines. fwiw, I was someone who needed a pregnancy terminated at one of these clinics. I had an incomplete miscarriage and was hemorrhaging very badly. I had some pretty good insurance at the time (it covered therapeutic abortions) so I called around to friends and they recommended the Johnson County clinic, so I made an appointment. When I got there, I was screamed and yelled at and told that they were writing down my license plate. They took pictures of me and the friends who accompanied me. It was horrible. I was already physically and emotionally at a low but to have those assholes out there, screaming "baby killer" to me, just about set me off. They don't want to know why someone made the decision to seek an abortion, all they know is that an abortion is occurring. Nor do they care why someone is seeking treatment at one of these clinics. They also provide other medical treatments. I went there a few years later for cryosurgery and got the same treatment from the Operation Rescue folks.
